banned from all marks and spencer stores?

my daughters college friend was caught stealing several items from m and s and my daughter and another friend were with her at the time- a dare which has proved costly. Unfortunately she was stopped when leaving the store and they were all taken upstairs where the police were called. When the police arrived they issued an unofficial caution to them all claiming that because they were with her they are as guilty as she is. As this was their first offence they were informed that this would not go on record as a criminal offence and they should be very careful not to get into a similar situation again as they would have the fact that they have been cautioned on this occassion on record and would certainly charge them next time and thus creating a criminal record.
does any one know whether it can be found by any future employer that this unofficial caution was issued.
they have also been issued with a lifetime ban from all m and s stores and she is wondering if this was a scare tactic or whether they circulate her details to all stores. I am so worried for her she is really struggling with her a levels at the moment and hopes it is not going to affect her uni admissions. Any help would be gratefully received.

She will have a police caution on record. There is nothing unofficial about this. Whilst employers etc probably wouldnt find out about it. Your daughter would be lying if asked and she didnt disclose and they later found out face the dismissal
As for banned. They will likely maintain a database. Its unlikely to be easily enforced but if someone does recognise she is banned they are well within their rights to kick her out in a reasonable manner
Frankly I'd be more concerned your daughter and her pals are stealing for a dare and what else these dares include.0 -
She would have to accept an official caution, i.e. admit she was guilty. If the police officer said it was unofficial I would guess it was unofficial. I think police and shop wanted to scare them, probably succeeded. It won't show on a CRB if its an unofficial caution. Their names could have been passed to local collator but not that likely in my experience.
Re being banned - local store will probably spot them if they go in again. Tobe honest in 6 months i don't support they will remember. I can't imagine that they are on some sort of "Most Wanted" poster displayed in every M & S in the country.Sell £1500

You could always frogmarch your daughter to the nick and ask the duty sergeant as to exactly the formality and visibility of the charge.
Frankly, she may be in with the wrong crowd - I hope she learns from this life experience.0 -
An instore bollocking by a police officer will not be recorded anywhere other than maybe an informal, local to that force "stop and account" database. This is NOT the same as the Police National Computer, it will NOT generate a Criminal Record and it will NOT affect future employment prospects. It's just that - a local informal method of trying to steer your daughter away from a life of crime.
As for the ban, M&S is private property and they can ban who they like really.

I hope you gave her a bollocking as well, if she is doing A levels she is presumably an intelligent girl so i dont understand how she could do something incredibly stupid as to risk a criminal record which could have potentially ruined any career shw wanted to follow. Mind i dont suppose she or you can understand it either. Hindsight is 20/20 vision.
Hopefully she has thought of all this now and its frightend the wotsit out of her and her friends.make the most of it, we are only here for the weekend.

I actually don't think it was unfortunate. The likelihood is that, if she had not been stopped, her group would have done the same thing.
Unofficial cautions are only recorded locally, so will not show up on a CRB.
M&S do circulate details of people that are banned from their stores. Some stores also circulate details to other retailers in the same town, I'm not sure if M&S do or not.Gone ... or have I?0 -

I think that answers the issue about the "lifetime ban".
She may get stopped when she is 85 and buying rose soap or something but I wouldn't worry.0
