Paypal taken money & wont give it back!

    Spoken to a more helpful customer service assistant last night. Actually got confirmed that it is a Fraudelent Transaction NOT the buyer saying the did not receive the item! Because we have Seller Protection and this states that this transaction was eligible we should receive all the money back. I have now also read all of eBays and PayPals terms & conditions on this protection policy & now more than ever im sure we are in the right & we should win this. The case has to be re-opened and reviewed so once again we are in the waiting period, unfortunately the dept who makes the decisions are not contactable via the phone so communication is limited to emails which makes things slow. The lady I spoke to last night was very helpful & even agreed with me on everything, she couldnt even understand herself why we lost the case!! At the moment im not getting my hopes up too much as I still think they will try & riggle out of their responsibilites somehow, but with all the terms & conditions printed & highlighted to be quoted to them im sure they will back down eventually.
    Tip: Do your homework, research all the websites help & guidance sections get your facts correct, record everything & dont give up!

  • Just to let you know...we won this case with Paypal and received all our money back. We are really happy about this and glad that we stuck to our guns and proved that we were right! It goes to show that doing your homework & sticking at it you should get the result you want. I do wonder though how many people this happens to and accept their fate without looking into it in more detail!!

    Maybe you need to raise a complaint with PayPal regarding their erroneous handling of this matter. If no-one complains they'll get away with it time and time again.

  • Yes, I completely agree. We are in the process of doing this as we speak. We doubt very much to receive a response but we feel we at least have to try!

    We had the same problem a few years ago, paypal found in favour of the buyer even though he had got the phone we sold and our money, the only difference being, we had a negative balance on our paypal account and we flatly refused to pay the money into our paypal account to cover it as we had done everything right! we were going back and forth to paypal to no avail, they didn't want to know nor did they listen to us. we just left it at a negative balance and stopped using paypal, we didn't hear anything else from them. i hate paypal, if i could use any other way of paying or recieving payments i would! useless, the lot of them!!

    Hi there, I completely understand your anger with them. The reason we won and fought so hard over it was because we were actually 'Seller Protected' followed everything they set out in their own terms & conditions and so could not understand or agree why we were penalised in the first place. Paypal had made a massive error in judgement and we had to then spend alot of our time and money in trying to resolve what should have never of happened in the first place! We will be taking this up with them I can assure you!

    Note to sellers and buyers: Make sure you are protected with every transaction (Seller/Buyer Protection) this will state if 'Eligible' on the transaction details page and follow all of Paypals guidlines. Avaliable via their website, under Terms & Conditions, i.e Send to address given by Paypal, not Ebay, retain Proof of Postage/Delivery etc. Then if anything goes wrong you are covered and will get all your money back.

    I hope that my experience helps others, and get in touch if you need any further advice.

    I have read a few Pay Pal horror stories. Like you advice says, only ship to elgibile customers and verified addresses :)

    The address doesnt even have to be 'Verified' as long as the item was sold/brought via eBay, just needs to be shipped to the address given by PayPal. Thats where they get a lot of people I think, they tried to use the whole 'well the address wasnt verified' with us but it states within their T&C's that it doesnt have to be to receive protection!! As long as the transaction states 'Eligible' and you follow the guidlines and can prove you did you will be safe. If in doubt dont sell is our moto and after many items sold successfully this was the first to have been an issue.
