    Thanks for that, does it show on CRB disclosure? As I said I have never seen it, seen all sorts but not that one.

    This was a genuine oversight on our part and whilst I fully agree that she should repay the extra money she claimed I do not think this "offence" should be on her records forever. She is not a criminal she is a lovely girl who restores your faith in the youngsters of today.

    When you think of the thousands of pounds the MP's have claimed over years and what do they get??

    A smacked wrist and a huge payoff!! Where is the justice??

    so sorry to hear this has happened to your Grandaughter. I wonder if it would not be appropriate for her to get proper legal advice on this. Many solicitors offer a free half hour and would be able to advise her exactly where she stands. I am not convinced
    that she will in fact have a criminal record for fraud. I do hope it turns out not to be so bad.. Best wishes to you both.

    Cautions issued by the Police are recorded on the Police National Computer and so will show on CRB checks. The same goes for Administrative Penalties.

    Cautions issued by the DWP (and local authorities) are not recorded other than by the DWP (so that if something similar happens in future the person wont get another) and so will not show on CRB - that is my experience and I give the cautions.

    Adpens are only held with in the Departent and won't show on a CRB however they will be cited in a court of law should another offence occur.

    OP you can try to get legal advice but as your granddaughter has already signed to accept the Caution I doubt they will be able to help.

    At the end of the day, your granddaughter has a responsibility to let the Department know that she is working/unavailable to care for you. When do we draw the line when something is 'a mistake'/'deliberate'. All cases of fraud must be treated and investigated in exactly the same way, because deliberate or not, your granddaughter for allbeit only 4 weeks, was not a carer.

    That is what I thought, so at least this shouldn't impact on her in employment. Just to add with the Police cautions, I know they should show on CRB but in my experience they frequently don't. I have had several job applicants admit to cautions which never showed up the the enhanced CRB. Must be a black hole for them somewhere.

    I agree, I know of two cases where cautions were admitted but didnt show up on the CRB.
