CSA ignored request to reassess, what happens?

Hi everyone, would appreciate anyone's help who may have knowledge of this:

My now closed CSA award was based on my original assessment from 2005 - I am the PWC. Case is closed since Aug 08 when NRP moved from the UK, NRP has not paid anything since June08, and I now have CSA working for me to chase arrears. (it is a very complicated case)

Since 2005 I asked for a reassessment due to some changes. I assumed this was done. My CSA case worker today agreed that my records show my 2 requests, but CSA did not take action on this, which obviously affected the amount I was due.

The reason for requesting reassessment was that the NRP could no longer claim reduction for having another child living in his household. (Covers a 2 year period)

My case worker is looking further into this, and will advise, but has agreed it was the CSA's error and that my situation is particularly complicated.

What should happen next? Would NRP be asked to pay anything extra which would add to his already accrued arrears, even though he never actually received a request from the CSA? (I have confirmation from the CSA they are writing to him to request payment of known arrears)

BTW, my case worker has told me they are awarding me £100 due to the way my case has been handled since NRP left the country. Little consolation really, I'd rather they did the job right in the first place.

    They do backdate where they have made a mistake, so he may well be asked for additional arrears.

    The case was closed on gounds of jursidiction. If it was closed in the correct manner it can not be reopened. As the error is due to the agency own making you need to have a assessment carried out using the existing information but removing the relevent other child the difference can be recovered as actual finacial loss.
  • Hi, thanks CMAC. There is doubt on whether the case was closed correctly. (This came from my CSA case worker) I think not.

  • Just an update, the case was closed incorrectly and is now being reopened. Will have to wait and see where these takes me now,thanks.

    Maybe if you concentrated half as much on your child and your own life, as much as you do on your ex-husbands, you wouldnt need to be off chasing him round the world.

    Ouch! do you have any info regarding the CSA or Remo that might help the OP, rather than try and half guess her parenting ability :confused:

  • Woody01- That is the whole point, I am concentrating on my child. She has needs which I alone cannot financially cover, nor should any pwc when there is a nrp out there ignoring their financial responsibility. By any chance, are you my ex husband in disguise, because you sound as bitter as he does.

    Blimey40 - thankfully the case was closed incorrectly and is now being reopened, so his arrears will be chased, thankfully for my daughters sake.
