    I think you need to sit down and discuss this properly with her. I think in the first instance you should explain to her you were expecting a month's rent in lieu of notice and see what she says. if she is unhappy about this then the fallback position should be to split the deposit.

    To be honest though if you weren't clear with her about all of this at the start then you are relying on her goodwill to see things your way.
  • I know it's probably the last thing you want to hear as it doesn't help but I deal with a lot of people living in shared accommodation and so much of the hassle I hear about could have been avoided with a simple written agreement. Well, that's not strictly true, the hassle might still have happened but you'd be in a better position to deal with it with an agreement in place!

    Sorry to hear it's been a nightmare and good luck with sorting it out

    is it a lodger situation?

    most people would define a lodger as someone who rents a room in a house that is owned by the landlord.

    I would deem you to be a group of people who jointly share a rented property.

    She is probably a little miffed that you seem to have your cake and eat it in a house that you don't own, ie you get to live with your GF and call all the shots, including stipulating how many times people can come around and if they can make tea or not, take a shower.

    I am sorry in her shoes I would have moved out too.

    The problem with the deposit and notice is due to the fact that you negated to set things up properly.

    I would give her back her deposit and find someone else to share with. It would be unfair of you to keep her money, when there is no contract place and neither of you can prove what was said verbally.

    Out of interest, can you clarify if your landlord is aware that you are subletting.

    How much is the rent in whole and how much are you paying and charging your lodger (although I use the term loosely) .

    I am not sure getting a couple next time would make things better for you as you stated the flat is fairly small.

    Wouldn't it be better to get somewhere smaller that you and your GF could afford on your own?

    To the last poster.....we pay the same as the lodger of course.....but its none of your business anyway. And please read the post before as I mentioned everything in there about subletting. And thirdly what exactly have me and my girlfriend done wrong, she was having someone over every day which is a bit to much....she knew we were a couple before she moved in.

    Fedo80 - you won't get far on these boards by being rude and patronising.

    As several others have said maybe the way you handled the situation is now why you in in the situation that your are, if your response to my post is anyway like your attitude and response to your lodger then maybe we can all understand why she moved out.

    Keep her money, and if she has any sense she will chase you for it through the small claims court - she seems well out of it!

    I got the firm impression that each person was paying an equal share but what could it matter? The lodger agreed to the rent, so she must have thought it was fair.

    I say, as you had a verbal agreement that notice would be a month then she either pays a month's rent or you retain a part of the deposit. I don't believe that any sensible person would go to the small claims court over such a situation, it's laughable. She sounds like a cheeky chancer to me who needs to get a bit more experience of getting along with other people. I really don't think she's being reasonable at all giving you a week's notice like that.

    A bit OT I know, but:

    Anyone notice anything strange about the OP's post count?

    They appears to be two OP's- one with a post count of 4 and one with a post count of 6:confused:

    Or have I lost the plot and need to get out more?:o

    It looks as if the person has two accounts. I was reading this thread last night and noticed only a green light was on against the name with 6 posts. I wondered why the green light wasn't on next to his other name with 4 posts. lol at least that puzzle is solved.
