Hi there my name is caroline
I am new to posting but have read so many pages on csa and how bad they have been with thousands of people just like me.
I recently put my frustration through in an email to complaints department and they said i may be entitled to compensation if the csa are of fault but so far they are trying to get out of it my case is for three children 10 13 14 and the case has been going on since 2002 and nothing i have phoned up lots and calls are registered but the complaints department said that not alot of notes had been written and the phone calls were not taped my x has never received any thing from them so they cannot get arrears from him and can only get it from when they get in touch with him soon ha ha a joke tehy said if they were to blame i could get compensation but it would take months for them to go through all information more time ha ha has anyone ever won a case for compensation with csa and do i get all monies owed i should have got of him or what anyone any ideas please thank you caroline

    Hi Caroline

You may find that a complaint can take quite a while before you get any outcome - I submitted mine in September 2008, I got my MP involved when I realised that the CSA were just keeping me dangling, now the complaint is in the hands of ICE and they have summarised a list of errors/ maladministration etc for the CSA to respond to. To date I have received £40 in compensation (for delays incurred since May 2008).

My complaint is based on the way that the CSA have handled my case - I am receiving payments (which are far too low in my opinion) but at least I am getting something from the NRP.

What is the reason that they have not made contact? Is it that they have failed to send out any forms, or is it that they have been unable to trace him? It makes a big difference.
Hi there sorry i didnt reply sooner but i didnt have my password

I did, I had a case for my eldest with the CSA since 1993, after years of nothing I complained to the CSA. They have a formal complaints procedure that needs to be exhausted before you can go to the Independent Case Examiner. I eventually got to that stage last year and received a couple of compensatory payments from the CSA for about £200 in total. ICE found that the CSA had been negligent and there was maladministration on my case. It was only once I had received the ICE response did I realise that you could make a claim for advanced maintenance payments. Luckily for me my ex had started paying back some of his 13K arrears at £22 a month (its been to court, baliffs etc).

I applied for an advance and lo and behold I have been told this week that virtually all my arrears will be paid to me .... I am awaiting the letter as I type.

Its taken 16 years and a fair amount of grief but by god don't I think it was worth it now!

And before anyone comments, I would much rather have had the financial help while my daughter was younger and wished that my ex had made the effort to remain in her life - but hey I'm not arguing with them now though!!:T This means I can spoil both my kids now!

    Hi there
thanks for the good advice i will look into the advance payment as i knew nothing about this can i do you think i have a chance
    Thanks
    Caroline
  • Hiya,
I've read in one of the other threads that some people have been awarded £50 via complaints. Seems a ridiculous figure.

I think you need to give a bit more detail in order to tailor your request so someone may be able to advise you, such as:

Is your ex paid in the UK?
Have you ever received child support from him via CSA or private arrangement?
Has an assessment been done on his earnings?
Have you considered involving your local MP?

I have lodged a formal complaint 3 weeks ago (via my local MP) and the CSA contacted me just last night to say they acknowledged the complaint and that they will get in touch with 15 working days/in writing. At least something is happening now, rather than being left helpless with some CSA twitt telling me they can do nothing for me.

    Good luck.

    Kat

    Hi there kat
Thanks for your advice`i am with the complaints department a lady called jacky but she has been on holiday for two weeks and tommorrow she is meant to be ringing me back regarding the case with my x partner its from 2002 till now but iclaimed a little time in 2002/2004 so i understand it will go from 2004 till present i havent contacted my mp yet and am surprised about compensation being paid of only fifty pounds i have not had any payments and the lady has adviced me there has never been an assesment done from csa and he has never even been contacted what are my chances of arrears if it is csa fault i did ring lots times through the years regarding the matter i have three children from my x 10 13 14 and had no money how can they get arrears from him if he has never signed anything or got a form this is csa fault and my kids are the ones that hacve suffered what will happen now then the lady siad if manmanagement was proven they would consider me for compensation is that what i have to look forward to fifty quid can you give me any advice please thank you i would really appreciate your feedbackx caroline

Its the csa they have never sent him forms this has gone on since 2002 until now i did though sign on in 2002/2004 so understand that the money in arrears should be from then i think then,
My case is with complaints a woman and she seems nice but has been on holiday for two weeks so hasnt done anything and still hasnt sent him forms to fill in are csa liable to make up the lost payments from my x due to there running me in circles but never actually getting form out to him
PLEASE ADVICE ME I AM NOT SURE WHAT I AM ENTITLED TO
THREE KIDS 10.13.15 AND NEVER ANY MONEY..

    Thanks Caroline

If they have never sent him any forms, not sure it can go back to 2002

My claim has been going on since 1990 and not a single penny. CSA are useless.

  • hi there its caroline again my case has now gone clerical and the lady advises me my x partner will be paying 44.00 a week for all the children thats in total there is not going to be any thing else arrears or anything i am dissapointed as i have been through the complaints department child maintanance and also all the procedures they told me to go through cant quite understand i do appreciate he is working for an agency he earns 300 per week and i have always had to pay the children to and from his house because otherwise he would nt have taken them but the last time i didnt as he has had the cheek to put in for reduction in payment because he has to travel two hours to pick them up which means it will go down even more i am unsure though on they said as the case had to be a new case because that was the fastest way of getting this sorted my arrears cannot go back to 2002/2004 because he was never sent the papers howe unfair is this on me no payments their mistake and where does that leave me they have sent me another letter asking for more info on him when they already know the information from how much he earns to it all i am just about to ring them back and ask for the arrears in advance from wait for it august this year because rhats when the clerical set the new case up is this right it seems unfair to me.
Can anyone tell me any advice and what i am entitled to ask for on arrears from august can i get them paid to me now instead of waiting i have been thoroughly dissapointed with all of this as you may see from reading my posts in the past .... what do i do now because if i am entitled to more i would like to know before i accept 44.00 possibly less after travelling deductions from this guy...
Am i missing something ...please any one give me some very good advice
    thanks caroline
  • hi there my names caroline i would like to thank you for asking and replying to my question i am at a point where there is going to be a decision but cant get arrears as it was the child support agencies fault they didnt send the applications out to him and i rang up through out the years and finally i complained they then put it clerical and although they have beeen ok not very fast and have assessed him on 44.00 a week for the three children thats in all not each he is just finding loads loopholes so the amount comes down even further i am hoping it wil get sorted out as it is just so gone on and on and they have said i wont get any backdated arrears through them not sending him the forms in the past and it was started up again as a new case and so i only will be entitled to arrears from august when it was passed to clerical is this fair ..
i know but its the kids money really and somehow i feel cheated by the childmaintanance is there anything else i can do i have had no one off payments or anything from childmaintanance i am ringing them today to be advised when i will be getting payments but i am not holding my breath ha ha
if you have any advice i would appreciate it could i get a lump sum for the arrears or will i just get something silly like 5.00 on top to cover from the august ha its a joke but any advice you may hav e would be appreciated totally thank you
    caroline
  • It took 18 months to secure provision for my second child through the CSA my X involved the INDEPENDANT CASE EXAMINER and was awarded £3000 compensation .
I only speak of my own experiences. and research that i have carried out whilst dealing with my own case with the child support agency
