The buyer that bought a bus and brought it back - Part 2

Just when we thought it was all a funny story that had passed - it's back!
A policeman was at my doorstop when i got home from tescos today.
The buyer has reported to my local policestation. Claiming that the bus was sold as roadworthy but isnt.
The policeman was very nice and as yet has no idea of what to do next!!
As many will already know - the buyer paid for a MOT to be carried out, the result was that there was a break problem conserning balance, which would fail a MOT.
Now the bus pased a MOT in July05 and was sold in Jan 06. So from my point of view - how were we to know of this problem - it was being driven often and had travelled to Ireland with no sign of this problem. How many people check brake balance regularly and before selling - not many i am sure! It would only ever come up on a test or service.
The policeman said he is going to find out how long it takes to cause a brake imblance and the possibility it occured after the bus was involved in the accident with a bridge!
Who's happy to se this tale back on the board?!! Not me! lol :rotfl:

To update - the buyer had insured himself when he drove it away - damn!
To answer the MOT questions. HE wanted another MOT becaause he thought there is a problem. He said the accident wasnt his fault it was the bus' fault! Wish that excuse worked when i crashed in to a wall...would have saved me money on insurance renewal!!!!!
The MOT did say there was a brake imbalance....but on reasearch this can happen sudenly at any time. It may have happend after the 'bump'. No way of prooving it - the police are trying to find out if we can be held responsible for the imbalance.
Evryone that hears the tale thinks its mad. Why is he wasting so much money and time on this. He could have taken it home - claimed on insurance for the damage he did and enjoyed the vehicle - or sold it...maybe even for a profit! Now he's added a £1000 on to the £800 he paid for it and wants us to pay for it!!!!!! Not to mention the £100 a week the garage are charging for storage. The garage had mentioned maybe scrapping it to pay for the unpaid bill but now police are invoilved i doubt they would do it

Fantastic! Well obviously sorry for you having to deal with this silly man but you should SO write a bok about this when you're done and sell it on E-bay
SO let me get this right... he drove away in a vehicle he had arranged insurance for and owned... he then crashed it. He failed to report it to the police but have told them that he crashed it (hence making them investigate it because he now claims it was due to a fault on the vehicle, thus admitting HE was driving it) I think if you crash into any structure like a bridge you have to report it in case it becomes unstable?
Anyway AS THE DRIVER it is HIS responsibility to ensure that the vehicle he is driving is SAFE TO BE ON THE ROAD. I do believe it clearly states so in the Highway Code? Same as it is his responcibility to make sure the tax and insurance is correct and so on
Now as far as I can see then the only chance he has on getting anything against you if you if you have PURPOSELY mis-sold the vanAnd so far I see nothing to suggest you deliberately set out to decieve him.
I wonder what would happen if you now filed against him for harrasment?Could be fun at any rate
Anyway brake imbalance can be caused by any number of things: Ceased brake calipers, air in the brake lines and I guess a knock from an accident by distorting the wheel allignment. As for whether this was already there then as he left it sat for a long time on your drive then it is entirely possible that the calipers could have ceased during that time
Anyway an MOT certificate clearly states only that the vehicle is fit for road use "at the time of testing"...

As we hadn't heard anything on the old thread for a while I was presuming that it may have all been sorted and you just hadn't had the time to give us an update... Well, that obviously isn't the case and I really can't believe that this problem is still a problem, why doesn't he just accept that he crashed into the bridge and it's probably his fault, all it takes is a small insurance claim, but no!

Is it a criminal offence to sell on a vehicle that is unroadworthy?
The issue of it being advertised as roadworthy but not being (allegedly) is a civil matter so nothing to do with the police. I don't really understand why they are involved in this at all.0
