    Why are you chasing this when you agreed to give up child support for consent to take the child to Australia?

    I live in Australia where nothing is free, in 2010 my daughter was diagnoses with adhd , odd. In 2012 she landed in hospital and was diagnosed with type 1 diabetes. She has also ongoing ear problems and has just had her 5 surgery since the age of 4 now turning 14. Surgeons cost was $2,200 to reconstruct her ear drum after it collapsed because it was so weak from ongoing infections and surgeries. That cost did not include anethitist, hospital costs etc. In 2009 when I agree to stop UK CSA I a) didn't agree not to claim CSA in Australia. Which for your information you have to otherwise they deduct it from your family assist which is like working tax credits and b) I didn't know she would have health issues. Do you think that another man has to pay medication which is around $35 a prescription to keep someone else's child alive. My husband doesn't have to but financially bares the financial brunt of the medical bills for my daughter. Why because he's a real man. I don't work as I need to stay home because she has several medical conditions which I'm not going into details but I also have 2 other children. I'm just wanting financial help to cover cost of her medical bills. Cake and eat it? Comments like that shouldn't be made unless you know someone's circumstances.

    I dont know a concrete answer to your questions but calling the courts in the UK for an update cant do any harm can it?
  • Call REMO in London and ask whether they have sent your CSA assessment to a court yet. For info, REMO work is now handled by the Family Court as opposed to a Magistrates Court, although they could well be in the same building. Then contact that court to check they have received it and ask what action they have taken so far and when you can expect progress. There is no reason why anyone would not wish to help you.     I still hear'd nothing, no summonses etc. ive all ways worked and been fully traceable if realy needed. Not moving address/ names nothing. She even knows my mothers address in ROI. I now have 2 children in this marraige 10 and 2.
    My son is now 19 and turns 20 in mar. I have just received a REMO from ROI ( still havent received court papers).

    1. Am i liable for back payments
    2. I stopped paying in 97 via court judgement not csa
    3.there is a csa record but it is closed down in 2001 and shown as closed and no arrears.
    4. The county court here in the UK allowed the divorce and signed the sec 41 of the matromonial causes act
    5. Am i time barred????

    Any advise would be greatly appreaciated .....DOM
    You say you have a REMO from ROI - what have you received exactly? A demand for payment?

    Some countries, Australia and Canada for two......both 'assume' that child support is being paid, and will deduct it out of any benefits. I know in Canada, if you claim 'welfare', then you have to provide details of the father, as if you are not collecting Child support, the government will. It's not the taxpayers responsibility to pay for children - it's the parent's.

    I 'agreed' to lose child support with my ex when I was looking to move - simply because he made them a money issue. He stood at my door and said 'yeah, they can move, as long as I don't have to pay child support and I can get on with my life'. Guess what....I moved, and then I went to court to file for child support. Alternatively, we would've ended up staying where we were (and with no job due to not being able to accept job transfer) for years, unable to move on in our lives, all because he wanted to 'sell' my children for the cost of child support. When we went to court, the judge commented 'it is not within the mother or father's rights to refuse to collect/pay child support. It is the right of the child to have it paid in order to help provide for them'.
  • Hi my ex wife took the children back to Germany 14 years ago which she didn't let me speak to them or see them until my eldest contacted me last year now I have and court enenforcement order for 105k backdated to 2006 but I paid 280 a month up until 2008 which she has not disclosed I have 30k of debt as I was unemployed for a bit after I left the forces due in court on the 24th got a solicitor what can I expect to receive and what or anything can I do some advice would be great
  • You need to be a bit more specific.
    What court made an order? When?Which court are you in now for enforcement?

    Thanks guys for your replys. So I rang the county courts and they had not received anything. So I rang remo in London who advised that it had been sent to the central finance unit at the magistrates court and that the case had been accepted. Remo also said that they had sent a letter to the australian CSa and we had 20 days to respond but didn't divulge what was in the letter. Does anyone have any ideas?
    Does anyone have experience and can tell me what happens next? Should I ring magistrates court and ask what is happening etc?

    The letter from REMO to the CSA will just be a standard acknowledgment. What happens next depends on how efficient the magistrates court is at progressing the application. Assuming REMO have told you which court has got it, there's no reason not to ring them and politely enquire what's being done with it and when you can expect to hear about developments. You should expect timescales to be on the long side since all communications are supposed to go from the court to remo to csa and finally to you.Don't expect quick results. Good luck.
