    His parents not being able to give him anything entitles him to no more. No he isn't classed as independent because of this.

    Did that, but they haven't sent the Death cert back, after 2 yrs.

    I've asked nicely, people have said we have it, write a request for it back. Done that, no joy, it upsets me having to explain the circumstances over and over, to someone who really can't be bothered.

    I don't know what answers you've had on the other thread, but even if it was the only copy you had of the death certificate, I'd have thought your energy should go into getting his loan status sorted rather than the return of a piece of paper.

    You can get another copy of the death certificate if it was the only copy you had. I ordered several when Dad died so that if one was not returned it wouldn't really matter.

    He would only be counted as an independent student if he met the criteria - being completely estranged, or being older and actually independent are what spring to mind. SLC make no assumptions, they just do the maths!

    Hi,

    Hope someone can help. I'm about to send an appeal off regarding my entitlement this academic year and wanted to ask if it's better to do it by email, or in the post? I'd assume that it should make no difference, but thought to ask for input.

    Also, could you advise how long the appeal process is likely to last? i.e. I'm already struggling and wanted to know to set my expectation level.

    I wouldn't expect them to get back to you at all! However if you send to their complaints department they are supposed to get back to you in 15 working days - that does not mean they will have actually dealt with it though!


    A question of my own.

    I had a very confising first attempt with student finance and with much phone calls and evidence sent it it got sorted... or so I thought, This year when submitting my application and end of year assessment I was told they over paid me by £9500!!!! After complaining I found out they had not upodated my husbands income and based it on a salary £4000 less than what they should have, I aprechiate he did earn alot more due to non-contractual overtime and a bonus. what I am not happy with is the fact that they reduced this years grants to £0......... What I recieve from them now equates to £288 per month, my childcare alone is £700 per month and then I have other 'priority payments' on top of that. By doing this Student finance are leaving me £1000 a month short (by the way we do not have holidays / do lots of unrequired shopping ect) ....... What I want to know are with my complaint what are the chances of getting my grants back? I am not refusing to pay it back (except for the error THEY made) I just want an alternative soloution.

    Is there any chance they would do this?

    No chance at all.

    You fall foul of Paragraph 119(10(a) of The Education (Student Support) Regulations 2011, in that you failed to disclose the overtime promptly. The paperwork that you sign for childcare grants does clearly state it is based on net income for the academic year, and your contract with the SLC also states that you agree to notify of changes that may affect your entitlement. You failed to do this, and when it has came to light, they are correctly reducing future payments to reclaim the overpayment.

    There is no chance of an alternative, and you have no grounds for an appeal.
  • Hey this is my first time on here and i hope i am posting in the correct bit.

    Last year i moved to Scotland due to medical reasons due to having family here.My daughter gained a place at college in Scotland doing a HNC course, she didnt meet the residence conditions to apply to SAAS as we only moved here in Sept 2010, therefore she was advised to apply to SFE.She was successful in her application and was awarded the full amount she applied for. This August she successfully gained a place at the same college on a Hnc course but in a different subject, and was advised to apply SFE again, this time she was totally unsuccessful, they say this was due to being funded on a Hnc the previous year.Whilst we understand that now, as we didnt have that info before. Can she still apply for a loan for living costs? As she is living away from home in student accomodation which she has managed to pay the rent,with work money she earned over the summer.Now her money has run out, i have had to give her little money for food. What can she do now? she was told to apply to SAAS for a living costs loan as she now meets the residency criteria this year, but when we telephoned them they said they didnt have to help her either. Please help this is such a grey area, i am unable to help her financially as i am on benefits myself.She has asked the college she attends for advice and they said they cant help.She even went to the job centre for advice butthey didnt want to know either.Please can you shed some light on this.Thank You

    So did she obtain an HNC last year, or did she leave the course without being awarded a qualification?
  • Yes she gained a HNC qualification.
