    So I complained to the seller. He has today put £25 to cover the cost of postage to send the item back and has promised to send a 'brand new 80gb'!
    We will see what happens.

    Just be careful- you only get 45 days from paying to raise a paypal dispute, so this could be a delaying tactic. Keep everything to do with this and send it via a reliable trackable method. If it gets anywhere near close to your limit without sign of a full refund or a new ps3 then open a dispute.

    I am with Turkish on this one, he is delaying you. You can't claim non delivery now if seller posted tracked to you, so make sure you post it back tracked in case you need to raise any other claim.

    Other than that it is exactly as per the rest of the thred frankly.

    I see some people never got anything but a refund.

    If the seller gives you a partial refund now (i.e. £25 to cover postage) you may only get £150 back later (assuming you paid £175) if it all goes pear shaped.

    It sounds like this seller is buying these items to order, perhaps from overseas, hence the 30-35 days from payment before you see the item. Perhaps his supplier isn't that reliable.
    (Edit: prices seem to have gone up recently too - a sign of a weak pound???)

    As others have said, make sure you don't run out of time to raise a dispute.
    Any reason you can't raise the dispute now for snad? It would still allow an exchange as a resolution - don't close the dispute until you receive the item you want.
    If you raise a dispute, remember it has to be raised to a claim within 20 days so that will either spur the seller on to provide a rapid exchange, or he'll just refund you as he knows he can't get the exchange unit in time.

    Thanks for your advice.
    I forgot to mention the day before it arrived (day 30) I raised a dispute for not receiving item.
    I will send the item via courier service so will have proof. Also have kept all email correspondences. He will send the replacement one once he receives the 40gb.
    This seller seems to provide refunds, one buyer received £50 as goodwill because item was not as discribed!
    One thing which explain how the seller gets the items cheap is that the box and games had Cash convertor stickers on them. Do you think he is an employee getting the goods cheap and selling them on himself? I know Cash convertors offer something like a third of the price they sell it for??
    Yes the recent PS3s he has for sale are now £190!

    Oh dear, that's a problem.

    Now you can't raise a snad claim.

    Is the item not received dispute still open? If so I'd be inclined to keep it open and remind ebay/paypal of their own terms that stipulate the item must be dispatched within 7 days of the seller receiving payment.
    If you don't push for a full refund now, you'll forfeit your right to any paypal protection.

    Remember you have to raise a dispute to a claim within a certain period - 20 days I think, else it'll close automatically as fully resolved.

    Of course by pushing for a refund, you wont get the PS3 you want.
    Your decision. Risk not getting a PS3 as you want or risk losing everything.

    And how many of the happy customers have extremely low feedback (;))?

    Also I really wouldn't want to deal with a seller that obviously insists on positive feedback to get around paypal holds:

    Hi all

    good news! I received a brand new used 80gb PS3! There was a ebay receipt in there which had Item number: 400060316869, and total costs £253! Strange! It looks like the seller brought it from another ebay user and had it sent to me.

    But still, there's something really starnge about the whole thing. He is buying lots of ps3 for more than what he is selling! his feedback as buyer has so many ps3. It just doesn't add up.
    Anyways, you got your item, so it's good news. enjoy it, but don't be like me and spend hours playing snooker on it! :)
