    I did post this on the DMP thread.. but I want to keep my 'Diary' up to date (for me) too.
    Well!

    I have been waiting for replies from my creditors (to my first letter/offer/token payment)


    I've been sooo nervous waiting..
    Anyhoo.. today two arrived! (well maybe one and a half.. we'll see in a minute)

    Nervous?? .. nooo.. I was flippn furious!! haha.

    The first one I read was from Hitachi Capital (DFS sofa) ...

    I can't be bothered to type it all out.. but here are a few quotes.

    'Whilst we appreciate that you are currently experiencing financial difficulties.. unfortunately we cannot accept your offer of £X per month. Failure to bring your account up to date will result in a default notice being issued. On expiry of the default notice if your account remains in arrears, it will be then referred to the litigation & debt recovery Department.

    We hope this clarifies the situation.


    Clarifies??? .. grrrrrr.

    I thought.. 'I laid my cards on the table in my letter.. you clearly took no notice of it.. (at ALL!)... Thanks for you help and understanding during my 'financial difficulties'

    Lets save you and me some paper work.. cut the junk in the middle and 'refer me to the litigation & debt recovery department' ..

    Letter 2 was from RBOS. It's not exactly in reply to my letter.. so I don't know if it IS in response to it.. or is a letter because I have now missed a payment and cancelled the DD.

    It's too gobbleygookie to type here.. But its something about a 'Amendments to the consumer credit act' .. that they' are required to give me notice of when a default charge have been applied' to my account. That two 'Default sums' (£12x2) have been 'Levied' to my account. That they are not entitled to charge me interest on the default sums for the first 28days after they have given me this notice, and that.. 'However if the sums are not paid in full by that date interest will be charged at a rate of 18.324%.

    What does that letter mean? .. is this something all together different? ... or something to do with my Letter/Offer/Token payment. .. dunno.



    Anyway.. not sure which approach to take with them next.. I just wanted to get that off my chest.

    Just sent Hitachi Capital (DFS) this:

    Dear Sir / Madam ,

    Re ACCOUNT NUMBER:

    Thank you for your letter of 19th May concerning the above account.

    I am sorry that you feel unable to accept the offer I have made. The majority of my other creditors have accepted the offers made to them and we have commenced payments.

    I cannot offer you more because I can only afford £X per month between all the other creditors, and it would be wrong to cease or reduce payments to all other creditors in favour of your company. The offer made to you is on a pro rata basis, as used by the county court.

    In the light of the other creditors agreeing to my repayment plan, please would you reconsider my offer. I will be making the payments in line with the offer to your company, on a monthly basis, as a gesture of goodwill.

    I look forward to hearing from you as soon as possible.

    Hi Eupho, hope you dont mind me popping along. Saw that you joined the payment a day thread - think it was you anyway lol. Thought i would come and have a read of your diary.

    Just wanted to wish you loadsa luck, dont have much experience of what your going through but i hope that once your creditors have agreed to plans etc everything will go alot more smoothly for you!

    Thank you for the encouragement. I've been sooo scared.. but at the moment.. I think I am starting to get a little annoyed.. haha!.. which ACTUALLY might be a good thing.. because I am more likely to come out fighting. :mad: ;)

    If you do accidently answer the phone to someone you don't want to speak to it helps to have plan in mind. Mine goes something like this:

    Them: Hello is that Moo2moo
    Me: May I ask whos calling please:
    Them : Its the money grabbing shysters here.
    Me: Thats lovely could you prove that please.
    Them: Of course and they rattle off lots of irrelevant stuff (doesn't matter whether its correct or not)
    Me: Sorry but you could have retireved that information from the recycling bin outside the house of the person to whom you have assumed you're speaking.
    Them: More irrelevant waffle
    Me: I'm sorry but since you can't confirm who you are I'm not at liberty to divulge whether or not I am who you think I am regardless of whether or not you think I am the person to whom you think you are speaking.

    They usually put the phone down in frustration, probably convinced I'm stark raving bonkers which incidently is probably very true.

    Hey Eupho, I just wanted to drop in and say well done for all of your hard work so far, you seem so very strong and determined which is a huge headstart in your journey.

    Hypno's post was great, awesome motivation there, I sometimes wonder why I am ambling round town on my days off doing 2 odd hours of mystery shops for a few pound but it does all add up eventually!

    I hope that you get some positive responses from your creditors and will pop back soon.
