    Sorry, let me clarify.

    I received the phone after about 3 weeks (foolish me!) and it had a missing component included in the listing. I also saw something on the phone which suggested it was indeed not as new as alleged.

    I opened a not as described dispute (that got escalated to a claim almost immediately - something about paypal not being able to contact the seller).

    I uploaded to Paypal emails from the seller in which she acknowledged that the item was incomplete and promised to send it and emails in which she confirmed the date it was originally bought.

    I hope this is clearer?

    I don't see why I should need a police report for what Ii believe is a trade dispute (which I assumed would be covered by Paypal's "Buyer Protection Policy").

    I don't think the police would be interested and am ready to send an email stating this to Paypal.

    Any ideas?

    no, the police certainly wouldn't be interested in what is, at worst, a civil matter between you and the seller. Log into pay pal and click on the contact us tab, follow the pointers for the telephone helpline, you'll be given a unique pin number which is to identify your call, you'll need to ring within an hour of getting this, trying to get through the automted phone system to speak to a real person is enough to make the calmest of people feel a bit killy, just keep saying 'agent' to the machine and you'll eventually get through, then explain to the agent that you have opened a SNAD claim and are willing to send the item back to the seller, and ask them what the whole police thing is about, it may be the quickest way to sort it as there has abviously been some mistake, perhaps they have confused your dispute with one for counterfiet goods or something.

    Whether or not you've left feedback will have no bearing on the claim.

    I tend to assume that paypal have got their 'dim' hat on sometimes and would do as others have suggested and phone them. Incidentally I have never had to wait more than about 5 mins to talk to a live person (well, I assume they were live, they did sound a bit sleepy!) on paypal.

    They make some very stupid mistakes and sometimes all it takes is a call reminding them of their own policies.

    I've called Paypal and spoken to someone who insists that I get a police report.
    In spie of all my entreaties, the guy insists that this is standard practice. He would not put me through to a supervisor to try to get some sense out of all this.

    I even had to push for him to acknowledge the receipt of emails in which the seller acknowledged the incomplete item was sent to me. He said that as what I sent in were screenshots of the ebay emails, they were not acceptable. I reminded him that I sent them in as attachments but I was told that "Paypal does not open email attachments in order to protect buyers". Still no joy.

    I've been advised to go to the police station and report this but I am worried I will look very silly indeed! He maintains there is a department that deals with such queries.

    I am truly stumped!

    this makes absolutely no sense, can you just clarify a few points for us,

    you have opened a SNAD dispute with pay pal?

    Do you still have the item?

    When you look at the dispute resolution page in pay pal, what does it tell you to do there? It should tell you to return the item to the seller by trackable means and then enter the online tracking number to confirm you have done this.

    A SNAD dispute does not require input from the police, you just need to send the item back to the seller, and confirm to pay pal that you have done this so pay pal can issue your refund under the seller protection policy.

    Waiting on PP now as I've faxed documents that I initially emailed. Hopefully that should sort things out and avert the potential embarrassment of a police report.

    That makes a bit more sense, it may be that the seller has been NARUed for selling fake or counterfiet goods on other auctions, and pay pal are treating your case as if the item was a fake, when in fact it is merely not as described. Sending it back to pay pal should elicit a refund for you eventually. good luck and keep us posted.
  • I'm soooo annoyed with myself! I tried to leave feedback for this silly seller and discovered that I cannot do so! It's been more than 60 days and the system won't allow me to.

    I am so angry that I was so tardy and the whole world will now never know what a pain it has been to deal with this guy.

    The dispute is still with Paypal BTW, heaven knows what's taking them so long.

    Is there anyway that I can leave feedback? WIll they allow me if I email them to explain that it was a bad transaction and I would like to tell the eBay community? I'm pretty sure the answer would be no!

  • Hi guys, just want to give an update. I lost the dispute/claim - on a technicality!!

    Paypal closed the claim because I did not send in the police report in the timeframe required!

    I am gutted!

    When I spoke to the agent to clarify the need for a police report, I got the impression that the documents I sent via email were not acceptable and was advised to fax them through.

    I did that and the status went to 'being reviewed by paypal ... we will inform you if we need more information by 26th July' which I relied on as a guide.

    How wrong I was! I checked the site and it was still displaying the same message then suddenly I get an email saying the case is closed.

    After several calls, I lodged an appeal and duly went to the police station where I was expressly told that 'it's not a police matter and advised me to seek legal advice'. It was with great difficulty that I got the lady to write me a letter to that effect.

    In spite of this, paypal threw out my appeal:

    "We are unable to process your appeal of this case. The supporting
    documentation you provided did not sufficiently follow our guidelines
    and was not received within the specified timeframe.

    We regret any inconvenience this has caused you and encourage you to
    work directly with the seller for further resolution".

    Upset. This guy has got away with cheating me.

    What recourse do I have? Hate being cheated!
