Sorry OP circumstances aside your post is a misinformed rant.

Tesco don't have any obligation to do any of the stuff you claim. It is the polices job to investigate and get CCTV etc.

Let them do their job and stop creating an irrlevant and unnecessary hassle.

The police are doing their job thank you. And support my claim to my rights also I might add, unlike Tesco. Which is my case and point.

Working for the ICO I have an in depth knowledge of our rights under the Data Protection Act, and indeed the Freedom of information Act. This was to help someone see what happened to her, and try to prevent it again, and hopefully also let you know that yes, you are entitled to ANY footage of you on CCTV or camera held by anyone, that includes city centre and neighbourhood surveillance.

This is uninformed?? What qualifies you to say that? Let me guess your a solicitor?

Thank you, it is reassuring there is some humanity left in the world!!
  • The DPA and FOI do not give you a right to all of Tescos CCTV footage from that store.

Nothing to do with freedom of information, true, and the data protection act doesn't give you a right to all CCTV footage. But it does give you a right to all images with you in them, on payment of a subject access request fee (think £10?).

On the opposite side of the coin, I was shopping in my local Tesco last week when a young girl ran in and told a manager that a woman had her bag stolen on the car park. The manager went outside immediately, calmed the lady down, brought her inside and called the police. She then got security to take two young men who had seen some of the incident upstairs to view the cctv.

Im not sure where you get the idea that Tesco feel they are above the law as in this case no one could have helped more.

I did point to this particular branch.

But yes Tesco policy actually prohibits CCTV footage being made available even to victims, if this store did show it to someone they have acted out of policy, and that is a policy I was assured of by Tesco Head of security for Northern Ireland during my first call this morning. I have now been told I AM entitled to what I requested, but it was more Tesco's neglect, or that of the staff I was more concerned with. This was to make Tesco bend a little to the 'little guy' and to get something back for the victim, if only some peace of mind in seeing how this happened.

Thank You!!! I have tried telling people this!! I think some people do not read what is in front of them.:T Despite my work with the ICO.

I only added that I also dealt with the FOI act as part of my work, my point here as you so rightly agreed, was the right to any store image of the requesting party to be issued upon request and proper procedure. Like anyone here is entitled to. And as long as there is no third party infringement.

Think people thought you meant all images in the whole store.

Plus Tesco can have whatever policy they like for informal requests, did your mum make a formal request and pay the appropriate fee?

Sorry but you're not entitled to the CCTV. I work in Security and have the CCTV SIA License.

    This is wrong!
If you appear on CCTV footage then you are entitled under the Data Protection Act to obtain a copy of that footage. You simply make a Subject Access Request asking for any data (in this case video/camera footage) they hold with you on it, pay £10 and the holder has 40 days to comply with your request or is in breach of the law and subject to a fine.

I dealt with it for her and went with her to hand written formal request to Tesco, when we were told that it is not store policy and refused our request. The fee of (up to) £10 required was offered.

I have this resolved as Tesco have had Head Office contact me and state that it will now be issued and the footage is to be handed over in accordance with the Law. ( As I have tried to say here)

This happened just after my inital post here, but they have not budged on the poor treatment at this store. One for the little guiy, one for Tesco. But I will continue until I get a satisfactory apology for the rudeness and treatment of a woman who was a victim of a crime on their property. All I ask is even a letter for her to let her know that someone from that store has a heart.

Sorry guys and gal's, this is something that people back off on too easy, but I wont let this incident be swept under the carpet from the branches standpoint. Put yourself in my shoes for one minute. Would you just give up?

Good on you for standing your ground Allan - they were in breach of the law (and probably knew it)
