Am I correct in thinking I was sold mortgage protection incorrectly since my employer pays 6 months full and 6 months half pay if I was off sick from work?

For the PPI element of the TMPP then yes. If it also includes life assurance and critical illness cover and/or PHI then no.

The TMPP policy is a multi-product plann rolled into one.

  • I'm pretty sure we were also set up with life insurance at the same time of taking our mortgage protection plan which does include critical illness cover, have we just been paying for 2 lots of life insurance basically?

Most people pay multiple insurances for to cover their mortgage. That is normal and quite right. Its when you overlap that there is an issue. The PPI overlaps with your sick pay. However, PPI does not overlap with life assurance or CI cover.

    Not necessarily.

If you were asked about sick pay and gave the wrong answer at the time then they would be within their rights to rely on what you told them unless it was manifestly wrong.

They can also draw your attention to any exclusion that might apply in your circumstances so that you can make an informed decision whether to buy or not.

It is also possible that the policy would pay out anyway.
  • I was mis-sold this policy when I took out my first Mortgage with Halifax. I was also made to believe that i had to take out 'that' policy before they offered me the mortgage. It turns out that they wouldn't pay out due to circumstances / benefits at work. I wrote to them and explained, went through the usual process and they offered me £3800. Fab !

Just so there is a start - no middle really - but an end.....

My mum and dad got £5000 aprox, from this bank.

It took two letters, one refund for £2300 offer which was returned.

The advice I got earlier, up above this post, is fair enough. But I never took it..... so go for it.

No doubt the next post will be about halifax auto-upholding every complaint and that mortgage insurance is a good thing.

    Not then it wasnt.

That is not accurate in my case.

Please anyone with insurance from Halifax, just claim. My parents got redress. You will too.

    Good luck

    :)
  • Only today, have I seen this thread, and have found it to be very useful !

I have a question, that I think I probably know the answer. But here goes.

I and my wife took a mortgage with Halifax some 12 yrs ago.

At the meeting to discuss the mortgage with the manager of the time. It was made very clear to us that for us to get the mortgage. We would first need to sign up for the TMPP.

I have since complained, using the PPI forms from here, and have been offered a full refund on the miss sold unemployment part as I was, and always have been self employed, and the policy was written as me being in full time employment.

I refused the offer thinking that the whole of the TMPP policy was incorrect. They had written that my wife was earning 10 times what she was earning. We did query this, and were told that it was nothing to worry about. I have explained all of this, and the situation to the FOS. They requested that I send copies of all relating paper work to them.

I do wonder now, if I might be wasting theirs and my time, as I obviously have no way of proving that we were made to feel that this policy was required, when in fact it wasnt.

    What are your thoughts please.

The TMPP is made up of multiple segments. Halifax until recently have been auto paying out on the PPI side but you need valid complaint reasons on the others.

Based on very limited info, your complaint is a verbal allegation. Easy to decline as there is no evidence. You would need to show you had no financial need for the other bits (i.e. life assurance). That is unlikely as you are married. Not many people dont take out life assurance on their mortgage.

  • Thanks for you reply, Dunstonh

I accept what you say, and no doubt will be hearing the same from the ombudsman.

I do find it annoying that an insurance policy that is meant to be a total package, is in fact not. Which means they can hold their hands up to errors in some parts, but not the package as a whole.

I find it astonishing that our written policy can be written with wrong information, and when queried, is normal.

But I do accept that there is no way of us proving that we were forced into this insurance, even though we truthfully know we were.

Packaged products are treated as individual segments. Chances are yours is auto payout rather than being upheld. If yours says goodwill offer, then that would verify it.
