    Surely a notice to end a tenancy is only binding if its written. As far as the counter claim goes, unless the OP happened to take pictures of the damage before they rectified it, then it is their word against the tenants.
    It's not easy having a good time. Even smiling makes my face ache.

    To the OP, if there is an area of black mould in the bedroom then how could the bedroom possibly not be damp?


    There is a world of difference between condensation (water going from air to fabric of building) and rising or penetrating damp (water going from fabric of building to air). Both Geenie and Penny Pitstop asserted it was the property that had a damp problem and this is not necessarily the case.

    Condensation is still a form of damp that can damage plaster, is it not?

    Why do you think that? Most contracts are verbal.

    If it isn't written then the landlord can just say you never gave notice and take you to court for abandonment. That's the reason why I've always given written notice rather than verbal anyway.

    Sure a verbal contract might be legally binding, but you would still have to prove it.

    The male in question was hospitalised with breathing difficulties after residing in a flat that had a BAD problem with damp.
    Upon threat of being sued the landlord met his, individual, demands.

    If the OP is willing to 'wing it' then fine, but DAMP & it's consequences are serious.

    It does sound like a nightmare tenant...but on the other hand, we're only getting the landlord's side of the story here.

    Being hospitalised for pneomonia is not exactly fun- unless the OP is suggesting they made that up too?

    I've lived in rented properties with mould - it's a serious business and if the OP wants to continue as a landlord, they need to get that sorted out properly in future, not just blame the tenant.

    That said, this tenant does sound horrendous.

    I suppose a salutary lesson to the OP to make sure that all their affairs are 100% in order in future; then they can't be taken to the cleaners by a dodgy tenant.

    I realise this is not exactly the right place for it (DIY board?) but as so many people are sounding off about it, what is the "cure" for black mould in plaster - chemical treatment or chop out and replaster?
    (please note I do not mean prevention, I mean cure for existing mould)
