    Bummer.... every so often I also copy it (right click, select all, copy) so I have it saved ready to just paste if it did crash or something.....

    Try and send a quick response - 40mins is too much info lol.

    All i need to know is the basics from the start, ie the debt itself - not what has happebned since as this means nothing..... I can guage with your replies the letters you sent which seems to be the problem, asking for cheese from the bakery - kinda should tell you where you went wrong! :beer:

  • Okay, I'm back

    6 CC's all pre 04/07
    CR file - defaults - C one, Egg & BOS

    Asked BOS for CCA. Sent 2 copies, neither have dates. One has old address, but not the address he was at when CC was taken out. Other has new address that moved to 18 months ago.

    Card is a BOS charity card for SSPCA and always has been this type of card. Taken out 14/15 years ago.

    Para in letter says 'As you are aware, this account was opened in 08/04/07 on your application, a copy of which we have provided to you previously'.

    Other CC's - wrote to COne, asked for CCA, they sent copy of current terms of agreement & Info leaflet. Then sent SAR letter on 30/6/09, heard nothing from them but passed to Capquest. Wrote back asking why been passed on when in disupte, replied saying that as he didn't sign letter would not send out relevant paperwork but cashed £10! Wrote to them saying do not need sig - still waiting.

    Egg - wrote for CCA, sent follow up letter - heard nothing from them.

    Hope this is not too long but had to write it tonight! Thanks again for all your help & hope answered all your questions.

    I recieved two warning letters, (I do not have them anymore though) But i did not receive a default notice, I have seen copies of some examples and I did not receive anything like those.

    Debt was cleared completed. A cheque covering the full amount was taken to the Abbey branch on 30th January 2007

    So a CCA request then yea? The default notice is not covered under this so they will not acknowledge that!

    Did they cash the original £1? Did they cash the second £1 - what questions did you ask and what were missed?

    Both PO's were cashed.
    Yep - they dont read the letters usually, if you do things wrong and they know you've done it wrong then you'll find they will mess you about. Whoever has been helping you to date has been sending you on a wild goosechase. Never attempt to sort these things yourself without proper aided help!

    You cannot enforce action over a request for info, for what purpose and act would you demand the answers? What were you asking?

    My request was for them to provide me with the copy of the Default Notice. If they were unable to provide that, I had asked them to remove the default from my CR

    Depends how far you want to take it and whether you think they acted improperly......

    A happy ending would be for the Default to be removed. As stated in my other post, I am in the process of starting the whole "buying a house" shin dig, if this is removed I believe it would be the end to my worries as I know them.

    do you remember when you got these warning letters? Was it about 2wks before the default date, i.e. 01/01/07?

    lol sorry - didn;t mean it to sound bad but people are in a rush to sort defaults and they take time! You need to learn a lot to do it right and even then there is no guarantees but jumping the gun can make you look daft and send you 10 steps back.

    Right then, so you only have 3 defaults? Is this correct?

    What credit agencies do these show on?

    You say you have 6 cards, 3 defaults - what is happening with the other 3 cards are they in arrears or up to date?

    Sorry trying to confuse you with defaults, there are 4. The other 3 cards are in arrears, Lloyds have put a default on but Mint and Monument have not. He had set up payments to Mint & Mon, they were agreeable to payments but others will not accept that what he is offering is all he can afford.

    I don't mean to sound awful but I think you've got a lot more on your hands than trying to remove defaults. If you're in arrears with the other cards then it'd be hard for me to commit to clearing defaults when more will appear. It'd be easier to do the lot or just let them all default you, ignore any mail they send and sit tight for 5yrs until they become statute barred.

    They cannot make you bankrupt, they cannot sieze your house and they certainly cannot come and take your possessions! Have a read here of the actual bailiff/DCA laws and then make an assessment of what would be best to do in your situation.

    Personally, you're fighting a losing battle when you still have other things that are ripe to bite you - i.e. monument etc.

    If I were you i'd just hide for 5yrs and not acknowledge or pay anything to anyone and return all mail as unknown at this address. Take your chances. 5yrs after the default date the debt goes away.

    Thats what i'd be doing but up to you.... either way, you'll struggle to get anywhere by hassling the lenders cos right now even if we got 3 defaults removed, 3 more will appear that will not be wrong as current action means they tend to do things right nowadays!

    sorry but thats the facts, up to you what you do with them.... :confused:
