The defaults are visable only on his Equifax file and the information held is as follows:

    Lloyds
    (Current Account)
    Default balance: £156.00
    Current balance: £155.00
    Status: Defaulted.
    Date Updated: 25/06/2006
    Start Date: 15/01/2001
    Date of last deliquent: 09/05
    Default Date: 05/09/2005

    Aktiv Kapital
    (Bank Default)
    Deafult balance: £156.00
    Current balance: £0
    Status: Settled.
    Date Updated: 08/02/2007
    Start Date: 15/01/2001
    Date of last delinquent: 09/05
    Date Satisfied: 05/09/2005

Both the accounts are under an address that he moved from in 2004.
He lived at his next address from 2004 until 2006 - this is the address he was at when he paid the balance - although as i said before he cannot remember who the money was paid to (presumably AktivKap as they show as "settled" ???)

    Thank you :A
    Plum.

    Hiya

Thanks for the info above. Can you confirm, after checking this post #878 (your original post) you mention the defaults were issued in June & July 2004. Yet the above suggests 2005. Please clarify which is correct as this makes a huge difference!

Are the defaults not showing on Experian then? Have you actually seen the experian credit file?

Did the OH ever get issued a notice of assignment, termination letter, default notice? Please be 100% certain of this answer!

    Cheers

Look above - i've done it for you lol

You need to keep going back into main menu for the page to refresh - so every so often, click the link at the top of the page that says credit cards (see here) Home » Forums > Pure Money> Credit Cards ...

Then from there, look for the Sutton Thread (see here) thread_dot_hot.gificon1.gifsubscribed.gifSutton's default removal letters (multipage.gif1 2 3 ... Last Page)

And click last page - this will refresh the page for you!

Ok, thats my mistake, after looking again the dates above are correct (June & July 2004)
The defaults are not on his Experian report, i have seen it and for some reason it only lists the last two addresses he has lived at (there is no mention of the address linked to these defaults at all)
This is where i'm a little vague im afraid, i dont know for def about the paper work you mention and he isnt sure, he says the only contact he had with Lloyds was a letter saying they had closed the account, he knew nothing of the default until htried to open an acc with barclays and he knew nothing of Aktiv Kapital until now.
    Sorry i cant be clearer!

    .

What I cannot understand is where did you get the two dates from, the above suggests a copy from Equifax.....

I need the exact copy of what Equifax shows - please type this for me so I can get the right date. The default was not in 2004 according to the above, it was on the date shown highlighted in red so where are you getting June/July 2004 from - help?!!!

Ok, well to be honest this default will drop off in 2011 so we'll send a letter and see what they say. Does he have ANYTHING or any memories of anything that would help me compose the letter? Its hard to fight for something without having a clue of the history!

Did he ever get send formal default notice - this is what matters (probs not cos you said he's moved around a lot)......

Has he moved since he paid the debt off, i.e. will Activ know his current address or was all this dealt with at an old address?

hi im sorry im totally rubish with this (not a clue)
He says he never recieved any paper work other than from Lloyds to say 'get lost'
Yes he has changed address since he paid of the debt, Aktiv Kap should not know this address.

Has he got a copy of the letter from Lloyds?

Right you have 2 options here.

    1. Try and fight for default removal, would also mean bringing up the past and this could then mean that the third address comes into play as a linked address and will then knacker his experian file.

    2. Leave things and in October 2011 (not long really) the defaults will both drop off and be gone forever.

My advice? I'd be waiting and sitting it out. Look at this thread: Who searches who and in it you'll see the companies that search experian - stick to this for the next two years and you'll be fine.

Hope that helps, just my advice but personally i'd not risk them linking me to the third address thus ruining my experian file at the same time. What do you think?
