    can you confirm was the default 7 years ago? i'm confused - please be specific as this makes a big different....

    If the account was in default 7 years ago then the account would be statute barred if you never spoke to or admitted any claim to the debt or the DCA within 6yrs - did you or am i reading this wrong...?

    Please be more specific cos i'm slightly confused.... cheers mate :beer:
    I will try to be clear,bear with me,I defaulted on this Egg debt 7years ago,along with others,I went through an IVA,ALL debts cleared 2 years ago,all other creditors apart from Egg and someone called Paragon who I have never heard off have cleared the files,but this 1 Egg says I defaulted last year,how could I?The debt should be clear,on all my credit files,Experian,Equifax,Callcredit there is NO reference to the IVA,so obviuosly I dont want that added,but I paid it off over 5 years as much as I could afford,and it was a lot,I did my part of the bargain,why can't Egg just clear it,even though its says'Settled' this default keep showing up,how doI get rid off,as it is not correct,many thanks,I hope this makes it a bit clearer,thank-you for your help.

    Thanks NID :) I hope I don't have to go backwards to get them to remove it, I can't afford to pay the debt off in full at the moment. It's still £600, so have to pay it monthly. It's a catch 22 because if they removed the late payment marker I could probs get another card to do a balance transfer to, but I can't get another card with the 5 payment marker (I doubt!). I'm going to try Tesco in November though regardless.

    Ok, don't worry - just wait and see what happens........ :beer:

    you havent missed much...i just wanted to check that my POC was ok. Abbey have admitted twice in writing that they dont have a default notice, I never received one, but they still wont remove the default, so I'm going to court.

    this is for an old current account closed in 2006

    Ok, go for it - it looks good but be careful, court may not be the best place to be right now and personally, i'd be prone to sit tight and issue threats.

    Its a risky ploy but good luck whatever you decide.....

    p.s. are you referring to POC as proof of claim or p!ssed off customer?

    I'm gonna go for it, i literally have nothing to lose right now, I cant get credit and it's all a big fat lie anyway...i never defaulted.
    time to waste some of their time. I think it's bulletproof...no default notice, no response to any data requests...the default should be removed in the absence of any proof.

    I'm still slightly confused as your not really giving me much to work with..... can you bullet point things in order as they happened to help explain it......

    Basically if the debt was absorbed into an IVA then they can still add a default as you'd have defaulted on their account.

    The fact some have been removed is a good thing, but if they wanted they could come back (until 6yrs)....

    Abbey called me yesterday and after a long discussion they said they had neither the default notices or any letters pertaining to my alleged arrears. They do however have all the notes made by their staff, which indicate that letters were sent.

    I'm just wondering how this will look in court. No copies of any letters warning of a potential default, but notes saying they were sent! Seems a bit flimsy to me. I didnt ever receive any warning letters OR a default notice, but Abbey claim they sent them all.

    They also stated categorically that there's no chance of them removing the default from my file. So court is the only way.
    Any advice appreciated.
