    Hi again,
    Thanks for replying. I'll check these things and double check as well! If they all seem ok, does it mean I'll hit a brick wall?!

    FYI-this was a loan and date of agreement was 27/01/04 and it was through Black Horse..not sure if you were asking for this or suggesting I check this on CCA so have included anyway!

    Yes I was asking that, cheers. Ok, check again and make sure the 4 corners are right and it's signed (deffo not been copied/cut/pasted etc?)...... check everything lol.

    If it's all ok and enforceable, then maybe claim charges and PPI back but other than that, yea you'll have hit a brick wall i'm afraid. Reliance on an unlawful agreement is what wins these..... :beer:

    Have doubled checked it all and it does seem in order! It is quite explanatory and comprehensive and does have all the info. Seems I'll have to leave it there. Was certainly worth trying though. It's also funny you mention it because I was just looking at the PPI and I nearly fell off my chair in shock! £524 worth of this for a £1500 loan! I was sooooo naive at the time. My ex husband used to talk me into things and if I knew then what I know now about loans, interest, PPI etc, I wouldn't've touched them with yours!!! Live and learn...lol.

    No never even thought of it until I read the agreement and saw how much it cost. Not 100% but think we have this cover via work as well! I do know it was never advised that it was optional to me when I signed for the loan because it was all on the credit agreement together with the loan details (although in separate boxes on the form) ready when we went in to sign for it. They had the paperwork ready to sign when we got there and it was sold to us as compulsory (as if it was just another part of the loan so to speak) and you couldn't have one without the other! Might give it a try re reclaiming-won't do any harm to send a few more letters. Not sure how that will fair with it being joint loan and me not having contact with my ex for 4 yrs tho!

    Yes, my ex was in a league of his own (and quite often a world of his own too) but as I said I've definitely learnt from it!

    Re the default-shall just have to wait til it rolls off but am very lucky to be in a position where it doesn't affect me too much at the mo.

    Hiya

    Deffo worth asking for charges back - use the templates found here - I posted link earlier for you. Just make sure you add a bit in the letter stating that you want all funds paid direct to you, in your sole name as you're the person dealing with the account not the ex husband.

    They should deal with you, being that they have pursued you for debt, also coupled with the fact a loan is joint means any/or is responsible so same respect with regards to refunds, tell them in your letter who to make cheque payable to...... they should comply.

    If the default isn't hurting you then leave it to drop off, its a bummer but if it doesn't have too much of an impact then i'd be prone to just hold fire.....

    Help anyone please!
    A few months ago after checking my credit report i found a number of default notices i knew nothing about, i emailed my Cra and requested all names addresses and account numbers of the companys that had placed the default notices, I wrote to these companies requesting a copy of my Ca some have responded but some have not (letter two been sent), the ones that have responded have said, as no Ca could be traced my accounts have been put on hold, but on checking my credit report again this evening the defaults are still showing and killing me how can i take this further, surley they cant place a default notice on my Credit file for a debt they cant prove i have, need these removing asap want to remortgage soon but they way my credit report stands i have NO CHANCE anyone have a letter templete i can send?

    Hi nid, sent that letter but still no joy, all i got back from companies was that
    Your letter has been noted and sent to the relevant departments to be investigated, we will be in touch at a later date.

    That was weeks ago and still no change, seems i have come to a stale mate!

    It can take ages, just hold fire and await a response. As you've read from this thread with others, this is a very slow process and pushing will not achieve much unless you fancy going to court (not my choice of a fun day out!).....

    Hold fire for a few weeks..... :D

  • Hi All,

    New to this so bear with me.....

    Got into financial difficulty a number of years back, basically borrowed way too much, however have now paid all these debts up.

    Checked my credit report a few weeks back to find I have 3 defaults registered against my name, one of which was by a compnay that I had never heard of - however the details of the account did match that of a loan I did previously have.

    The main problem with this account was that the loan's status was "Default" with £5400 outstanding - however I know this loan and it was paid up over 3 years ago.

    I started an online dispute for the company (Wescot) to come back saying they had no records or details for me and that I should contact them.

    The other two are as follows:

    1) HSBC Current Account - which I was never made aware of being defaulted
    2) EGG Card - again never received any default notice for

    Not 100% sure where to go with this, any advice would be greatly appreciated. :confused:
