    Hi
    I am new here and was hoping someone could help me get rid of my default. My card was in dispute then hsbc gave me a default then stole the money out of my account! i therefore now have 0 balance and a default! is there anything i can do?

    That was my follow up letter after they ignored the SAR...seems to have worked too. I had to send them a SAR as they allege I entered into an arrangement with them and then defaulted. The only way I can prove they're wrong is if the provide me with all data relating to the account in question (statements, default, correspondence).
    I cant prove anything without the info to hand...or I should say, I CAN prove everything by the fact this info never existed, was never sent, or was erroneous.

    Did i do something wrong? Your pages only came to my attention after I sent the SAR.

    Ok thanks - makes sense now. I see where you're going with this, but if it never existed and they have added derogatory data against you then you'd be best just to use the legal backing and get it removed via unenforceability due to error....

    However, what has happened - have they responded since you sent the second letter? Just remember never speak to them, only deal in writing from here-on-in.

    Keep us updated if/when they respond :T

    Help would be sooo apreciated.. as its a funny one due to beinga utility company!

    I have a default from British Gas!! These templates dont really count as it wasnt a credit agreement and i understand it they do not have to issue defaults??

    Basically i moved house and had outstanding issues with them such as 3 gas leaks in 3 weeks, me thinking my meter was not correct as i was being charged £300 a 1/4 when i work away mon - fri. Them digging up the outside of my house nad entrance to my home so not being able to get in etc etc. and having to spend nights with parents due to no gas in winter due to gas leaks.

    anyway i did notify them of my new address definately... i moved in dec 2007 and in oct 2008 they slapped a default notice on me! they passed my file to dca(who had my new address even tho i wasnt on the electoral role at this point) prior to default being issued.

    i went through all this with the dca who said they would pass the file back to british gas and i would hear in due course... andyway at this point i was 9 months pregnant and our new arrival came, so i forgot all about it expecting british gas to contact me to sort out this mess then i could pay what i owed! They never and i got the default - only found out due to checking my credit file.... not spoken to BG yet. Any advice?

    i really could do with getting rid of it as i want to study with OU but failed their credit score for the finance for the course!!!

    they havent responded just yet, but they've cashed the cheque, which makes me think something will be in the post to me in the next week. I never speak to them on the phone, that just used to wind me up!
    I will keep you posted and let you know what they send.
