a quick update for you...Abbey's response to my SAR reminder, which gave them an additional 7 days to respond on top of the original 40, was to send me a standard letter about how they're handling my complaint!! I've received this same letter about 3 times now.
I think it's time for court, do you agree? They're already in breach of the DPA and are now clearly just taking the !!!!.

I am I wrong in thinking the newer the default, the more likely it will have an impact when being credit checked? As I remember reading somewhere that defaults older than 3 years are somehow not as bad

not necessarily - defaults period, are bad. What my interpretation was based on was Tesco - they only look at 3yrs, whereas Halifax apparently look at 2 (seen that recently in banking thread)..... to be honest I think they assess it on its own merit, some people with defaults can get accounts whilst others can't. Likewise, people with a default got citi accounts last year, no chance now - they are harsh scorers!
It swings in roundabouts - no hard set rule afaik....2010 - year of the troll

Court will just enforce it - go to ICO. Report them as ICO can fine them - a court cannot. :beer:

Have opened a complaint with them. My priority though is to get the default removed. I know you're juggling loads of requests, but can I assume they dont have the default notices if they havent responded yet, or are just swamped with complaints?
I'm in Catch22...I cant prove I didnt default (i didnt!) unless they provide me the info I requested. I can prove my case in the absence of their alleged proof. They havent responded to SAR and CCA requests, so i dont know whether to call their bluff and just go to court. If they produce evidence there they will look stupid.

I've just come across this thread and have found it fantastic re the advice that's been given so I'm hoping someone might be able to help me. I have 1 default showing on my otherwise clean credit record and this was registered by Black Horse in July '05. This was for a joint loan with my ex husband whom I discovered was not making the repayments on this (as well as many other things) and by the time I discovered the extent of his lying this default was on my file. Luckily all of the other debt he left me with hasn't been recorded against me but think that was because I 'caught it in time'. I have paid everything back. I'm completely aware that I was jointly liable with my husband for this acc but at the time I was married to him I had no reason to distrust that he wasn't paying it as we had agreed. As soon as I discovered the default, I made arrangements to settle the account and up until very recently I just thought I had to put up with it being on my record but after having read this site, it seems there may be another way. I actually read the learnmoney site before this and have (rather hastily it seems) sent a CCA request to Black Horse. This was received by them on 03/06/09 and I have had no response. I did however tell them they had 28 days to reply as I had just pasted the letter from the learnmoney site. The 28 days will be up on 01/07/09 and I'm just wondering if someone could advise what i should do next?
FYI-I NEVER received any default notice from them but I have to admit it is possible they sent one and my ex kept it from me.
I know some people have said just to let it roll my file in couple of years but if it's posible, I'd love it to be done sooner.
They have also cashed the £1 cheque I sent as the statutory fee but that cleared my account on the 8th June so I was expecting to receive some correspondence from them not long after that. I know they have until next wed to reply as per my letter but I just have a feeling I won't get a repsonse..and of course after reading his site, I have discovered they should've replied within 12+2 days...if they don't respond then VERY cheeky to cash my cheque!!
Apologies for long post, I just wanted to make sure everything was on that was relevant. I'm also new to this so hope I've got it right!

Hi all, got a problem with capialone been on going for a while had enough of there un helpfull staff so requested a copy of my Ca, recieved from them a piece of paper just standard terms and conditions containing my name address and credit limit that was it, replied to this with a letter requesting a true copy containing my signature yesterday a day before time was up! again recieved the exact same letter, where do i go from here should i next send account in dispute letter? Now am also recieving letters from there DCA (debitas)they need me to phone them to discuss payment of my account immediatley!Also all this has now ended in a default notice registered against me which i knew nothing about until i got an alert on my experian account!0

Am reffering to the barclays default removal letter. Just want to live a normal life, which seems impossible for now with the default.
