I know this is off the subject a little but i really need help!
I have found two defaults on my credit file that shouldnt be there.
basically a credit card i paid and cancelled and was told i ws in the green with aged 18 applied a default and no say i never had an account and dont exist. Their call centre staff are so hard to understand and they dont respond to any letters i send.
the second is a bank which i was in dispute with via mail (still awaiting their within 14 day responce to the letter they sent 2008!) they basically lost my online savings account so i complained basically banged my head off a wall forr 3months. I was then told by branch staff just to put 50 quid in my over draft till they found my online saving account but to without my kn owledge the bank just sold my account to a debt agency without me knowing and im still waiting for this letter as to where the hell my savings are??
please please help me im literally tearing my hair out

LOL< its the ex singlepoint..... singlepoint was the phones 4 u network that used to take you on, regardless of credit status, if you had a credit card......

Does the word default appear on your credit file or any late payment markers? If not then dont worry, 6yrs after closure it will vanish from your file but a paid up account is not a bad thing you know!2010 - year of the troll

Hi Nid, I dont have Default on the phone contract. All I got are 'Satisfatory' and 'Settled'. In experian, its green 0 all the way. I guess that means my payment was on time?
But on Equfax, its green 0 all the way until last month. Last month is green S. like

Exactly right on both counts - this looks good to other lenders, shows you have managed the account perfectly well and it is now closed/settled.

Now I am working on adding my HSBC credit account on my report. I only have one credit card and its missing on my file. HSBC has sent the agreement form. Hopefully got it sorted soon.0 -

Thought I would keep you posted with the latest developments.
As you know, I'm in the process of trying to get a mortgage, first time round it was declined.
There has since been an appeal with Halifax, its been past the underwritters, seen by the Quality Assessors and the last response from Halifax was that they can see that I have been in talks with Abbey and are happy that, in their opinion, they believe the Default should not be there (doesn't really do anything though!) however they need evidence or a letter of some sort from Abbey to that effect, which I guess is what I am also waiting for.
I sent off a copy of the last two letters and a copy of my NOC from Experian to the IFA who passed those on to Halifax so they are both awear of the current situation.
I know you said to sit and wait, but is there anything I can send Abbey to say that they are not treating my complaint fairly and that it is holding up my application? or will that just send me back to old kent road without passing go?

An update since sending out our CCA letter before my first post on page 59 of this thread NID.
Santander/Debenhams, have sent back the signature page of what looks like a Debenhams storecard application.
It is my wife's signature :mad: , but here's the strange thing: it was a previous address that is on it and not my wife's then current address. This explains why my wife had no correspondence whatsoever to do with the card or the default.
Furthermore, the address that is on it isn't the handwritten part but is printed and has a barcode next to it. The rest of the application isn't enclosed which is frustrating as this sheet doesn’t give very much detail as to what was filled in at the time of application.
No information about what the cost of what was initially purchased was on it either, so we've still no idea what caused the £100 or so of default
Are they legally bound to send the whole application or just the signature sheet?
My wife is insistent that she provided them with all her details for the previous three years, and is unsure as to why they had that address on it. She never chased it after moving home, as she thought she was signing up for a discount card. Her english isn't the best so I truly believe she didn't know what she was getting herself into.
It also looks like my wife had been duped into signing for the Account Cover Insurance as well!
What do you think our next plan of action is? Are we pursuing Santander/Debenhams now, or still Aktiv Kapital?

This doesn't matter and to be honest your wife hasn't helped matters cos now you'll find it hard to do anything, you've just told them to prove the debt and they have. Lets be honest, for that agreement to have a previous address she must have lied when she filled it in then?
I asked about this remember? I clearly said to you 'did she apply and then move' to which you said we moved a few months later! So how did it have the previous address on it, you tell me mate?
Something doesn't add up here, it didn't when I first started reading your posts and now it's just been confirmed. Whilst i'm all for helping unenforceability I am sorry but I cannot be seen to condone fraud.
I asked you several times to check with her and told you in no uncertain terms that she did take the account and you asked her and again she denied it - why did she do this?
Her English isn't the fault, come on mate - you can't really use that. I asked you to ask her did she fill anything in, you said no. Now all of a sudden she did?
So based on the above i'm sorry but I can't really be of much help anymore. You've broken the golden rule which is never mess up or you lose all credibility - nothing that you send will now help, the facts are that she took the account; you asked the lender to prove it - they did. End of the matter. :mad:
Had your wife been up-front then we'd have sent a different letter which would allow us to pursue other avenues.
Basically you need to consider sending in a CCA request and then follow the process hoping that they do not have the original CCA. If not then you may be able to stop them chasing you but the default will remain. You should only be dealing with the lender as you never seen any assignment papers. Ignore the DCA and deal direct with the lender.
