HSBC taking money from my savingds account

    no , i had no standing orders , or DD for that account and refused an overdraft but yet they are refusing me my money which was paid for the fact for my children
    But haven't you refused them £500 of their money by going overdrawn without asking them first?

    You agreed when you signed their terms and conditions:
    16.3 If any accounts you hold with us are in
    credit, we may use any of them to reduce
    or repay any amounts you owe on other
    accounts you hold with us anywhere
    in the same name (including any card
    accounts and any joint accounts) whether
    or not those accounts are in the same
    currency. If we decide to do so:
    • we will tell you why and when it has
    been done; and
    • in doing so, we may (and you irrevocably
    authorise us to):
    – bring to an end any fixed deposit
    period applying to any of the
    accounts you hold with us and adjust
    any interest payable by the Bank;
    – convert to sterling at the prevailing
    market rate of exchange any balance
    that is in a currency other than
    sterling; and in doing so we will have
    no liability to you.
    Nothing in this clause will prevent us from
    exercising at any time any other right of
    set-off or of combination of accounts to
    reduce or repay any amounts you owe us.

    Another way of looking at that is that they refused you money but you went ahead and spent it anyway. Some may call that theft. They do in France. We ought to treat it more seriously over here as well.

    Note the key word: unauthorised. You authorised them to do this when you opened the account (see my post above).

    The relevant paperwork (i.e. the Terms and Conditions that you agreed to when you opened the account) is outlined by BruceyBonus in post number 12 above.

    Whether or not it is in the Ts&Cs the banks have the right to take the money . (according to this article which I have already linked to above. http://www.moneysavingexpert.com/protect/setting-off)

    The above is correct. Banks have the right to take the money from savings account but.................not JSA! They are not allowed to take this!

    I suggest you open another bank account elsewhere!
