Got a charge certificate?

Hello

Does anyone have any advice as to what I must do. I received a charge certificate and haven't the foggiest what its all about. It appears they sent me a penalty charge on the 18/03 but I didnt receive it. It states I am being sent it for one of the following reasons:

You did not reply to the penalty charge

We did not withdraw the charge for the reasons you outlined in your representation and I did not appeal to the appeals service

The pta rejected your appeal and it has not been paid.

Bit difficult if I received nothing. Where or whom do I appeal to from here I am quite happy to go to court if necessary.

    I cant even remember the offence, apparently I turned right at a no right turn.

    Ahh - I can't say much about that.

    There may be issues of signage and any photo being misenterpreted. Trying pepipoo would probably be a better bet.

    Which Council?

    Procedure is to wait for the 'Order for Recovery' (will be £5 more than the Charge Cert).
    This should come with forms to make a Statutory Declaration - to the effect that no PCN was served (let me guess - newham?).
    You get this witnessed for free at your local County Court and send it off to Northampton TEC (forms will explain). This restarts the process.

    DO NOT sign the Stat Dec until in the presence of the Cty Ct officer, who will then witness it for you.

    then we set about the original matter of an appeal.

    It was actually camden council, however it it usual to receive a charge certificate and not a NTO?

    for moving traffic contraventions, yes. There is no NtO stage.

    I would advise you to put Northampton TEC on notice (google it) That way you have less chance of missing the OfR (important).

    you could also contact Camden and ask for a copy of the original PCN. they will have to produce it eventually anyway.

    just called camden and they said they dont send copies of pcn's I would have to send back the charge certificate explaining I never received the pcn in the first place.
