I would take a note of the next phone call (time persons name etc) and tell them that if they call you again you will go after them for harrassment. Then send a letter and ask them to acknowledge it in writing to say they have recieved and understood, and in it state the time and persons name etc and that you adviced them that you will as said on the phone, raise a complaint of harrassment with the appropriate authorities if they continue to phone you

I had probs with several creditors continually calling at the beginning but the CCCS advised that all debt collectors are supposed to adhere to a strict set of rules and if you feel that you are being harassed or treated unfairly it is quite easy to lodge a formal complaint. Try out https://www.oft.gov.uk for advise.I've learnt that life isnt about what you have it's about who have.:T0

Couldn't help notice the part that you are an additional card holder and the account is actually your OH. This being said they are not allowed to discuss the account with you unless they have a written or verbal agreement(the later usually requires a password) from your OH to allow them to continue talking about his account with you. This i am sure is a serious breach of data protection.
But I am no expert on these things so I will hand over to others that are more clued up on these matters. I would assume your OH has real good cause to make an official complaint.

I am going to get OH to make a complaint to MBNA when he gets up,none of the other creditors will discuss his other accounts,only my own.We were warned from payplan that MBNA are one of the worst companies they have to deal with,and that harassment is one of their fortes,has anyone else had any problems with MBNA?

Report MBNA straight away.
They're not allowed to call you at unreasonable times, and they're not allowed to discuss the account with other than the a/c holder unless they have permission from the a/c holder0 -
Thanks all,OH made complaint to MBNA about discussing account with me,they say they can talk to me as I am additional cardholder,got a bit heated and they will not back down on this.Also complained about calls after 9pm and got major sorry from them

One question I've got is that we had letter from MBNA today saying they will issue a default notice on our credit file if we do not pay arrears,what exactly is a default notice? and what are the implications? OH phoned to find out and they said it could affect future job applications,is this right?Debt at highest £102k :eek:

a default notice will affect your credit rating.
i can't see how it could affect future job applications - your prospective employer would have to tell you in advance that they were checking your credit record. I've been employed by two different financial services companies who you might think would check and they never did. it sounds like they're just trying to frighten you. don't let them!

Just starting to get very stressed and worried about the weeks ahead until all settles down,letters and calls keep coming in with all sorts of claims and bullying statements,don't feel ready to deal with it all and worried about losing our home.
At what point if ever do the courts get involved? and is it sometimes better if they do?
It is good to read so many of your positive stories,it does give some hope that things can turn around,only wish we weren't in this mess in the first place.
