    lol theres many laws that are floundered daily and probly by dizzy like the rest of us im sure a multimillion pound profit making company like tescos will not quibble at selling apples at 70p when the sel says 99p.i think its criminal the waste that could be distibuted round the surrounding areas just gets put in a skip by tesco and other leading supermarkets i think dizzy is probably a tesco shelf stacker looking for promotion by hoping mr t reads these forums lol...just my opinion which im entitled to:beer:

    The price you pay is the price at the till - if that is lower than the advertised price then that is Tesco's problem - not yours.
    I am NOT a mortgage & insurance adviser - or anything to do with finance, that was put on by the new system I dont know why?!

    Then it wasn't correctly priced on the system, someone didn't do their job properly, my point still stands....

    No they don't........... Tesco can only compensate you if you have suffered a financial loss. You haven't suffered a financial loss as the contractual price was agreed at the till, the price on the Shelf Edge Label is only an 'Invitation to Treat'.

    Tesco actually offer a 'goodwill' payment for the difference.

    Similarly Tesco do not have a unilateral right to rewrite the contract to charge a higher price if they decided that they charged too little at the till...

    Regardless of if it is a retailer mistake . At the point that you pay , if you are aware that the price on the till is lower than the actual retail price . Then you committ an offence, If you pay for that item and attempt to leave the store.

    There is several things here that have to be proved .

    Intent to perminantly deprive - This in this case would be the monetry value left to pay on the product .

    Dishonesty - Here this is where the knowingly part comes in. If you dont notice it when it is going through the till and the misprice is not noticed by a memeber of staff then there is no dishonesty.

    I know ( although confused as dazza.mk) states how it works if the cutomer is overcharged or not given a promotional offer by the retailer.

    It all about knowingly paying a lower price . If you didnt know about it no problem. At the point you are paying for the product the item still belongs to the retailer . If at the point of payment you know you are paying the wrong price compared to the advertised price. Then you could have problems..
