    No advice, but have some hugs :grouphug: and definitely follow it up in case you can claim something back from them for something!

    Thanks for all your support my fellow posters! I've calmed down the past couple of days but i'm still angry how they let me go!

    Ok i'll tell you what happened with regards to some questions that have been asked and I was wondering if anybody can tell me if my boss can do this?

    Basically I was called into my bosses office first thing Friday morning. He says it was not working out. He explains that I don't have much enthusiasm or comittment to the company (well its hardly supprising when I hardly have any work to do, I've not been trained to do do much and I've been there for three months and my boss hardly has anytime to show me anything!!). He then asks me to leave the premises......I must point out here that I did not sign a contract (no one in the company has but one was being prepped a couple of weeks before I left). I didn't even know how long my probationary period was!!

    I got a letter on monday explaining this but I will phone ACAS to ask their advice.

    I got the job through an agency and he said to them there was nothing wrong with my actual work just my general attitude to the job (but that is explained above!)

    Can he let me go on the spot without any warning? I did not steal or bring the company into disrepute or anything.....Its got me so confused!!!

    If you are on probation, they only have to give you a weeks' notice. They can ask you to leave immediately, but they still have to pay you for that week.

    That's the law I believe. It's only if you are on probation, otherwise they have to go through proper procedure.

    But you didn;t have a contract telling you anything, so you might be able to 'get' them on that.

    This is from Gees employment law
    "Any person who works for someone else in return for remuneration...is in a contractual relationship regardless of whether there are any written terms or agreements."
    "However ss1 & 2 ERA 1996 require that employees must be issued within 2 months of the commencement of their employment, with a written statement of the terms and conditions under which they are to be employed"

    If you have had neither and were not told about a probationary period then I would have thought that you would have a case for unlawful and or unreasonable dismisal. You should have been given official warnings if they were unhappy with your performance and there is a specific procedure to follow.

    Unfortunately some companies think that they can get away with not following procedure because most employees will not make waves. Do get advice from ACAS and CAB - I think you have three months in which to lodge a claim.

  • What type of company was it, and what was your position, can't make a judgement on your "enthusiasm or comittment to the company" as we do not know what you did,
    was it a sales position, did you interact/or not with your collegues?

    Were you working for the company or the agency? If it's an agency they can say "hi and bye" with great ease and no come back.

    If it's with the company it sounds like you have a good case for unfair dismissal. You could force them to re-employ you, reclaim your money and work somewhere else, and may also be able to get compensation on top of monies owed.

    From what I've experienced, Agency staff can be relieved on the spot, no warning.
