legal help regarding vehicle swapping?

    We really dont think he has a leg to stand on, but he is a big guy and wont let you speak on the phone, I feel we are being forced to swap back.

    Would you advise parking the car else where tonight?

  • Wouldn't hurt. If he ask where it is, you can always say you've dropped it off at a garage to get checked over or something.

    If he's a big guy make sure you hit him first!

    edit: I probably wouldn't actually as it will only inflame the situation immediately (hiding the car that is, still hit him first).

    Take care not to damage the car when you are parking it elsewhere. Although I don't suppose he would demand it back once you had told him it was written off.....

    In that event, he would expect you to keep it, as indeed he would if it failed to start, perhaps from a loose lead to the crankshaft sensor, or something equally crucial for starting the car.......

    Do you think I should give the police a call just in case he turns up on my door step?

    I mean i don't know the guy from adam and am a little worried as i have a 14 month old son at home, What if he does come down?

    I've done nothing wrong here so i don't want some pis'd off northern bloke turning up on my doorstep because apparently his son doesn't like the exhaust system!!

    Should i be worried?

    if you feel intimidated then sure, tell the cops.. that's what we pay our taxes for... i guess you have his full name and address.. not so easy if he's from out-of-town, but perhaps you or the cops could check the full electoral register to see if he's listed on it..

    on a legal point, what are the terms of the contract through which you exchanged these vehicles, and were those terms recorded in any permanent form?

    did you agree a "cooling off period", for example?

    do you have any obligation to return the vehicles, if one of them is found later to be defective, for example?

    this is not a criticism of you, since swapping items of value often seems like an excellent way of saving money, but it is so fraught with pitfalls.

    Almost invariably one party decides after the event that they have had a poor deal. Swapping was the mainstay of trade within our school, and much of it took place in secret because of the problems that followed. I can remember doing some incredible swaps, only to be forced to hand back the goods or face a beating!

    Well I have been on the phone for a while and he talks over you, will not let you speak, and tells me he will be down tomorrow weather I like it or not to get his car back, he sounds like he use's his son as a weapon time and time again.

    I'm not happy, we did a deal, I dont trust him one bit!
