legal help regarding vehicle swapping?
I advertised my vehicle for sale on a well known car site and was approached by a person who wanted to swap his vehicle for mine, I was a bit dubious at first and left it for a while.
I recieved an email fron the person a few weeks after and asked if i had thought any more on swapping vehicles, As my car hadn't sold i said i would think about it and get back to him - After thinking i decided that i would go ahead and have a look at his vehicle, So we met up yesterday and we both liked each others cars so after much talking and deliberation we decided to go ahead with the swap, WE WERE BOTH SATISIFIED WITH BOTH THE CARS AND BOTH TEST DROVE AND INSPECTED EACH VEHICLE - JOB DONE 2 HAPPY CUSTOMERS!!
Or not as the case may be......
Today i recieved a text message from the other person and he told me that his autistic son was petrefied of his now new vehicle and is demanding that we swap back.... I'm a little confused to say the least, should he have not thought about his son prior to going ahead with the swap??? i certainly would have if my son was known to have problems with loud noises - being a Subaru Impreza - They are very well know for a flat 4 engine and a big bore exhaust - Which is what he wanted!!
Now i am worried as he is threatening to come to my house and take the vehicle back - Does he have a spare key?! I'm a bit worried.
Legally i don't know where i stand as i signed the log book to be the registered keeper and so did he....
There is nothing wrong with either vehicles - Both sound mechanically and bodywork is fine, Both cars are really good but i'm a little annoyed that this person almost forced the swap upon me and now is demanding that we swap back.......
HELP!!!

if his story is true i would feel sorry for the boy
but you can tell him to do one!0 -
I would be more concerned that there is some sort of scam going on.
I.e return a stolen vehicle with false plates on it and sell your's
Be very careful either way.0 -
I think you may find some of the parts have been replaced or it was used in a bank job
One scam is like the above said they return a nicked car with your plates on and sell
yours in a quick sale.0 -

possible but i doubt he would tell the OP he was planning on coming back to get the car0 -
I dont think this is the case guys, I dont know where you live but fair doo's.
I dont think his son has been near the car as he got back late last night and stright out to work today, so when would his son been near it or in it..
I think he is getting ear ache from his partner about coming back with a 300bhp Subaru Impreza, He is calling back at 8.30, all conversations will be recorded when he call's0 -
Thanks, you are a great help, just a figure of speech!Chippy_Minton wrote: »How the fook would we know?0

Legally (assuming everything else is in order) the car is yours no question about it.
However as others have pointed out i personally would be wary of it being a scam, you wouldn't be the first person to think a con man is a genuine guy - irrespective of you where you live.
If your happy that its not a scam and its down to his missus or his son, then its completely up to you how you deal with it. Again he's not the first one to come up a interesting excuse just because of buyers remorse...believe me i've heard some corkers (again from people that i thought were upstanding citizens - i believed the story and late found it to be cobblers).
Let us know how it goes.
I'd take a note of the chassis and engine no's and take some photo's just on the off chance he does have a spare key.0 -
N.b. might be worth a quick trawl of the motoring forums to see if he's on there trying to find out the opposite angle.0
