osps new tricks- help and spread the word

hai everyone,

Unfortunately i got the phone on 22nd october 2005 from osps. (without reading this forum first).

1. According to the first letter, i am entitled for 52 pounds cash back on 22nd November(automatic cash back). AFter 4 calls, 10 emails , i got 26 pounds only(after 3 months). CS says - cash back reduced from 52 to 26 and the rest will be given alongwith cash back refund i.e. 4th, 8th and 12th month. ? Is it breach of contract or not.

2. While this argument is going on - i was eligible for 4th month cash back - sent 4th month bill i.e. 22nd February invoice with the slip by registered post (having read the problems faced by forum members with lost cash back claims even when sent by recorded delivery). Got the reply that the invoice is wrong and i need to send the proper invoice. I pay by DD to the orange - so 22nd feb bill will be debited from my account on 15th March. They did not mention which is the correct bill to send. for my simple mind if 22nd october is the starting point, 22nd feb bill will the 4th month bill. This seems to be the new trick by osps.

3. complaint mechanisms given on this forum are no longer working - bbc watchdog link, osps sufferers forum link etc.

I am left with one option - online legal claim as suggested by one sufferer.

any other suggestions - if none - for others to know that this is happening.

    This happened to me last time a sent a claim, so I waited for the next bill, like they kindly told me, sent that off and got paid. Do not understand what your problem is. I agree it is a bit confusing that they now ask for proof that the 4th months (for example) bill was paid ie. they need to see the 5th months bill. Perhaps we need a sticky on how to keep OSPS sweet !

    Same situation as you. My billing date is 19th of january and i started my contract on 9th of january 2006.

    So do you now have to send the 22nd march bill for the 4th month cashback?

    what's the betting if other forum members send the equivalent of mak's 22nd march bill they are told they are too late for their month 4 cashback claim? :rotfl:

    documentation is quite clear..you sent the right bill.

    Had a smililar problem back last October, the original info said to send the 4th month bill, I took out the contract in July and had a bill about a week after I took it out. My 4th bill was October which I sent and they sent it back!, however; when I contacted them they said I had to send the bill for the 4th month...so in November I sent what was the 5th bill but 4th month of contract and within a week I got my cheque :).

    Best bet is to ring their CS and aske which bill...Don't forget to use http://www.saynoto0870.com/ to get a geographical land line number for them, you can then use your free minutes to ring them :)

    yes same problem here i am used to sending the 4th bill however with osps its the 4th month, i.e. i ordered on 1.12.05 and sent mt 4th bill on 2.3.06 i was told to send whatever current bill i have on 1.4.06 so it will probably be the same one which is totally daft + i am still waiting for my automatic chequeback due within 1 month!!!

    It is not normally the 4th bill. It is the bill that showed u have been connected for 4 months. This is normally the 5th bill.

    Regarding they given u only half the automatic cashback, they are breach of contract. Write them a letter demanding payment of £26 within 7 days as they are in breach of the Sales of Goods Act 1974. If they dont pay up within that time you'll sue them through the small claims court.
