I asked that question because it happened to me.
My OH had lost the receipt (actually he never keeps them).

I asked them if they would be prepared to give me gift vouchers instead, which they were.I purchased a similar item, which was a bit cheaper, and they told me "they don't give change from gift vouchers". I asked them if they coud give me the change in £1 gift vouchers.Problem solved-you won't find the answers on Consumer Direct.

You won't find that bit of common sense in the SOGA.

Every situation is different and there are different ways of solving problems.

I agree about the common sense bit, but the vouchers where only given out of goodwill, they could have said no, and I agree that "there are different ways of solving problems", but the whole point of this type of thread is when common sense doesn't prevail and the seller will not abide by the customers statutory rights.

"Only " given out of goodwill (I don't think there was ANY goodwill from those staff, trust me,they were seething when I got the vouchers etc)makes no odds to me.

And they didn't say no,whereas you did.

I got my money back in a situation where the law says I can't have it,and i had to push (but very politely) to get it.I believe it was because they then had to go and get authority from a Manager who ok 'd it,so I in effect, allowed it to be taken higher ,with minimum effort from me.

It is a little bit also about understanding how retailers think. They don't want to part with any money, and gift vouchers are still keeping the money within the system,as is going to the manufacturer under the guarentee (it doesn't cause a loss to them.)
You have to play them at their own game, make them bend their own rules, and smile.

And who cares how we get our money,as long as its legal and easy.:D

If you have no proof of purchase then you will be very unlikely to get anywhere.
I have been quite lucky in the past then.

I took back two Breville items to Argos. One a rice cooker and the other a food processors. Both items had broken of their own accord (the food processor was a second replacement! I don't like Breville anymore), I had the box for one and not for the other.

I just took them up to the counter in Argos, told the girl they were both defective (I had no receipts), explained they were presents (which one had been) and they gave me store credit for both items for the last known list price in Argos. Fine with me as we had other things to buy anyway.

Yes you have been lucky as they are under no obligation to do anything without proof of purchase, ( this does not need to be a receipt), and have done so as a goodwill gesture, but you did the right thing by going back to the retailer :T

    From Consumer Direct; -
"Shops will often tell you they will only give a refund on production of proof of purchase. Don’t be mislead into thinking this must be a till receipt. It can be a bank or credit card statement, although you may run into difficulties if it is for a different amount than that of the item you are trying to return."

Does consumer direct tell you even without a receipt ,you can get a satisfactory outcome just by speaking nicely to them?

    No,I thought not.

They inform you of your statutory rights not goodwill gestures by businesses, that is what forums like this one are for.
