New Car problem... where do i stand

I bought a brand new car about 2 months ago and recently i noticed the paint onthe boot cracking near the badge so i took it to my nearest VW body specialist and they said they wouldnt touch under the VW warranty scheme as it had been resprayed and to take it back to where it came from..

So the garage sold me a brand new car that had the boot resprayed without telling me what can i do?

    Go back to the dealer you bought it from and tell them to fix it under warranty.
  • I'd get a indepandant inspection done on the rest of the car to see if its been resprayed anywhere else. Then take it back to the offending dealer play holy hell and get them to sort it out.

    Before anyone bleats on about rejecting it: By all means have ago but unless there has been serious damage and a large portion of the car has been resprayed i'd be very suprised if you managed to reject it succesfully.

    what would sorting it out be respraying or replacing the panels? because if they couldnt spray it right first time i dont have faith in them sorting it second time

    Three-Year Paint warranty

    All Volkswagen passenger cars are provided with a warranty for a period of 3 years from the date of first registration against any manufacturing defects with the paintwork.
    The only preconditions are:
    • The defect must be reported to a member of the Volkswagen Authorised Network as soon as it is discovered. This must of course be within the warranty period.
    • The defect must not be due to external influences such as accident damage, climatic, thermal, chemical or industrial pollution, insufficient care or maintenance. This will be determined by the member of the Volkswagen Authorised Network at the time of inspection.
    Body protection warranty

    All current Volkswagen vehicles are fully protected during manufacture against through corrosion for 12 years from the date of first registration (6 years for the Sharan models).
    The only preconditions are:
    • The defect must be reported to a member of the Volkswagen Authorised Network as soon as it is discovered and within the warranty period.
    • The perforation must not have been caused originally by damage, neglect, insufficient care or maintenance or by external rusting.
    • A member of the Volkswagen Authorised Network must be advised about any rusting as soon as it is found.
    • All body repairs will be carried out promptly in accordance with the manufacturer’s specification and procedures, using only approved parts and materials, so the original level of anti-corrosion protection is maintained.

    my local VW garage say they wont honour the warranty as the panel has been resprayed by someone else! I guess its not classed as a "manufacturing defect"

    however i bought it like that brand new on a 09 plate from a garage further away who must have knowing sold me the car new knowing the panel had been resprayed and deliberately kept it from me

    I bought a lemon of a merc, paid £35,000 for it and it had loads of problems so I contacted trading standards who secured me a full refund when the car was 10 months old.

    I paid cash for my car if your car is on credit you have a lot more protection than I had.

    So what they are saying is that since you bought the car you have had an accident and are calling you a liar? You will need to contact VW UK direct then complain about the dealership and ask them to investigate.

    the cars brand new on a 09 plate. ive no problem other than this paint on the boot.. could i demand a replacement boot or would a respray just be enough for them to fulfill there comitment

    You are getting ahead of yourself you need them to accept responsibility first. But I do doubt you will get a new boot.

    so you think i might have trouble getting them to accept responsibility? whats the best way to play it?
