    Hi
    I am going BR, and have a small surplus each month.
    Am I right in thinking that if both myself and my husband are on pensions with no other income, that an IPA would not be allocated anyway?

    I also would like to ask - on the BR form to fill in, it asks about tax paid in employment etc. I pay tax on my pensions. Where do I put that, or don't I?

    Hi,

    I am going BR and have a mobile phone contract. I sold the mobile phone when I started the contract as I have an older mobile which I was happy to use.

    Can I add this to the debts to my creditors and include it as part of the BR.

    I would then use a PAYG sim instead.

    Hi,

    Please can you help me with this, I forgot to ask when I was on the phone with the CCCS this morning discussing my impending bankruptcy.

    I have two savings accounts set up for my children, I use it when they are given money as gifts from family and friends. They each have aroung £350. Will they lose this when I go bankrupt? The money is not mine, but the accounts are set up in my name for them as they are only 3.

    I would hate for them to go without due to my stupidity. Please let me know whether or not the money is safe. If not, am I entitled to withdraw it and keep it until I can set up more accounts for them?

    Hi Flower,

    When your budget was worked out by your OR there should not have been too much surplus left over as the money will be needed for your living costs.

    As an undischarged bankrupt the OR could look at your finances at any stage and if there have been any changes to your budget, you would have to inform them as soon as possible.

    i.e your circumstances did change but you did not tell them!

    You would be able to write to the credit reference agencies and ask for a notice of disassociation. I have attached a link to Equifax’s website and there is an online form you can use. You would need to also do the same with Experian and Call Credit.

    Hi Saf,

    If you’re no longer using that mobile then the debt would also be included in your bankruptcy.

    Just to clarify CCCS_Sarah's reply, the OR does not normally ask for you to prove anything, they do not usually ask for proof of income or expenditure during you BR period.

    The only exeption is some OR's have been known to ask for wage slips when the IPOQ form is returned near the end of BR, but not always

    But the point CCCS_Sarah was making is they CAN if they wish, at any time up to your date of discharge, or even after, but only for info upto your discharge date, unless you have an IPA but normaly that would only happen if they either suspect you have not updated them, or someone was to report you for living beyond your supposed means (trust me it has happened:rolleyes:)
