They where rang on the 07/03/09 and where ment to ring back but didnt. Got a letter on the 10/03/09 saying thanks for your letter on the 12th lol. Then got a letter dated 23/03/09 asking for loads of info and meeting which we had on the 30/03/09 at 11am.
So to me if it goes from the frist letter there time is well up they had 56 days its well over 60 now (AM I RIGHT)
If this is a case is there anything any where with the 8 week rule on it? As I cant see it in the waver! If I ring or go to the bank id like to make sure I have the full facts so they cant try and pull the wool over my eyes.
Im going to send this letter giving them a last go at sorting me out. Do you think this letter will do or is there anything I need to add remove?????????
I refer to default charges applied to my account amounting to £2183.29, which I have requested you pay back.
I wrote to you on 12/02/2009 making the original request for a payment in settlement of my claim. As I have not received an expectable response from you, I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court.
This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the court will rule in my favor.
If I do not get a full and final response by the 07/05/2009 I will start the above court proceedings and also make a complaint to the Financial Ombudsman. As I feel the bank has not been dealing with my hardship case in the right way as it has been ongoing from the 12/02/2009.
I look forward to a full response to this letter within 7 days; otherwise I will commence court proceedings to reclaim my money.
Yours faithfully,

Join the club.My folks have been phoning every few days and always get told that the bank agree that they are in hardship but they are in the system and it will take time to process their claim.Still no letter informing them of this or any kind of offer from the bank so how they can process something that they havent offered beats me.
Finally got an offer from the bank but my folks arent sure what to do from here. The claim was for £745 but the bank have sent a cheque for £205 and a cover letter stating that the payment is NOT made in full and final settlement but there is no mention of how they are going to proceed about the rest of the claim.
I've suggested that my folks cash the cheque and send a letter asking about the rest of the claim but thought i would ask on here and see if anybody has had the same response from their bank.
Thanks in advance0 -

No bank can make a full and final settlement until the conclusion of the OFT test case issues. However, if the amount doesn't clear priority debts then by all means accept but ask that the amount be increased(they can either say yes or no).0
