They have 8 weekes from the receipt of your letter, after that time, you can go to the FOS if it is still outstanding.

they should respond initially acknowledging your hardship claim within 5 days, then they get 8 weeks before you can go to FOS.

My frist letter saying I was in hardship was sent on the 12/02/09 Then my 2nd letter was sent on the 02/03/09 after not hearing from the bank.

They where rang on the 07/03/09 and where ment to ring back but didnt. Got a letter on the 10/03/09 saying thanks for your letter on the 12th lol. Then got a letter dated 23/03/09 asking for loads of info and meeting which we had on the 30/03/09 at 11am.

So to me if it goes from the frist letter there time is well up they had 56 days its well over 60 now (AM I RIGHT)

If this is a case is there anything any where with the 8 week rule on it? As I cant see it in the waver! If I ring or go to the bank id like to make sure I have the full facts so they cant try and pull the wool over my eyes.

    Still no news.

I rang the bank last monday to be told by the manager she would have a yes or no for me on tuesday. So I rang back to get a v.mail saying she is on hols (why tell me that if she knew she was going to be off)

Anyway tryed ringing the girl who was covering her 5 or 6 times and she would not return my calls. So rang the customer care manager in head office belfast. But yet again would not return my calls.

Today I got hold of the manager at last. But yet again saying il know something by weds but if not could be an other 4 weeks.

They have yet to say yes your in hardship anything to me.

If I go to the fos/ombudsman that could take months. I did think hardship case where ment to go faster.

How long do they have from your frist letter to say yes or no? ( mine was in on 12th of feb) The manager seems to think she as 8 weeks from the date I had a meeting with her.

Is there a site with this on it?

Im at a loss and dont know what to do or what my rights are.

  • If you don't go to the Ombudsman it could take months by the sounds of it so do it now.

Have a chronological timeline, ie I first approached the bank re bank charges on x date, applied for hardship on x date, went into branch on x date and they have not responded(is it coming up to 6 or 7 weeks?)
