My rights on moving out of my council flat.

I have a four bedroom council flat and my 84 year old father has a seven bedroom council house.
My father is unable to look after himself and as a result I have been forced to care for him. He needs 24 hour care which I am unable to give him unless he moves in with me or if I move in with him. I asked the council for a 5 bedroom flat for me, my husband , 3 teenagers and father, but they refused.
He can not live with me as I have no spare rooms and the flat is crowded as it is.
I want to know if I have the right to move in with him with my family, how should I approach this?.
Many thanks.

Sorry OP can't answer your q but just noticed you say your father has a 7 bed council house - I didn't even know 7 bed council houses existed....doesn't it cost him a fortune (in electricity bills alone).

ps I would ask the council re rights of succession....which is what you are getting at I guess - different councils have different rules.

  • No, its around twenty pound a week he hardly ever has the lights on, but I had 8 siblings growing up, my dads lived there for thirty years and all of us have moved out so he's there by himself.
  • oh btw its the same council, camden council.

AFAIK carers don't have any automatic rights of succession but you could do a swap perhaps (although the bedroom limit rules might stop that). Then he could give up the flat to live with you in the house.

In my area only one succession is allowed but it may be different where you live . (Although if it was your family home maybe yours hasn't been used up).

Whatever your plans I would clear it with the council first unless you plan to hold on to the council flat and move back when you are no longer needed (if dad goes into care home) I imagine this situation of similar is fairly common.

this a wind up? Why would 1 person be allowed to have a 7 bed house for 20 quid a week?

When other families are now more needy. Just smells fishy ifyswim

I think it was the electricity that was £20 per week if I read correctly

Wow. I am humbled. Father living in 7 bed council house, daughter living in 4 bed council house. Am humbled indeed.

Unintelligent to 'scim read' a piost i think not ;). I was probably alarmed at the fact your local council is wasting a property... that surely is needed for some other family. And even then... your post mentions only the 'costs'... whereas the post you referenced to above (which you hadn't quoted btw) mentioned the costs and sub-mentioned the leccy. Easy mistake to make.

And if its taking up your oh so valuable time, dont read my comments. I have no experience of sharing/donating,claiming council houses but im sure someone will be along to tell you how you can get the 7 bed council house. I've no idea how he could afford the council rent charges on such a place (hence the suggestion of a windup).

I think you should sue for compensation.
