    Morning people!!

How is everybody? :money::money:... Good luck to all winnners & triers!!:):)

Hubby finally got paid out from Natwest yesterday!!!!!:money::money:, however, there was £300 missing..when hubby rang up this morning, they stated that it was the tax that should be paid on the refund??

I thought it was up to the person to pay the tax yourself not the bank paying it out of your refund before you have even got it!.....and to add insult to injury..he has waited over 3.5 months for the cash and there was no extra interest on there either!!

He was told he would have to wait until the break down figures arrive to confirm this ....jeez, by the time we pay the cmc (I know... this was in jan 2010) we will have pittance left!! HELPPPP!!:money::money:xx

Glad you have got your redress for your complaint ;)

Im not 100% about the tax payment but it would have had to have been paid by yourself or by them but just make sure it states they have made this payment of tax in your letter. ;);)

I would also check in your offer letter to what date they calculated interest too and then give them a call for each full month over their calculations as you are due this too ;)

Yoohoo :D tax can be deducted at source, make sure the cmc dont take a % of this tax you paid, you have not got this money HMRC have,if the company kicks up a stink tell them you will report them to these
    http://www.justice.gov.uk/global/contacts/claims-management-regulation/index.htm

Dont give the company anymore than you have too,ask them for a breakdown of their charge to make sure they are not robbing you, they wont be allowed to take a % of any money that was taxed.

Finally recieved response from Yorkshire bank today rejecting my parents claim for PPI on a credit card they have had for 20 years. When we first asked for a copy of T&Cs, they could not find them, now though they seem to have found them. They say they rejected the claim because on the application form, they were told to tick a box if cover is not required, which my parents failed to do. Then in 2003 they a statement was apparently sent which referred to changes in the plan, and that stated they didn't have to take any action if they wished to continue enjoying the benefits of the payment protection plan.
They then go on to say, that because the policy was set up in 1990, and not queried until 2011, and that because the premium charged for the cover is clearly shown on the statements, that my parents were quite happy with it.
All though they have offered a sum of £1100 because from the age of 65, the cover should have been replaced with hospitalisation cover and never was.
Do we now complain to the ombudsman, or exept their offer.....
Hi there, this is hard,as what they are saying is true, that parents accepted this and the payment was made monthly and they should have known this,i think the money they have offered is good.
If Yorkshire have sent a letter out in 2003 asking if they want to continue this, then you would have to prove that this did not happen,Yorkshire may have this letter on file, although that does not mean to say it was recieved by your parents.

There is a chance that if you take this to FOS they will agree with Lloyds and the offer Lloyds have made may be withdrawn.

You could get back in touch with Lloyds and ask if they could repay from the last 6 years, you never know, they may compromise ,you wont know until you try.

Good luck with this and please let us know how you get on.
