Ok I will also send them some statements relating to my savings accounts in that case, I have actually ended up editing the appeal letter quite a bit to take into account different things.

I wanted to check, when sending this appeal letter and documents is it ok to send photocopies of the documents or will they require the originals?

Another point is that I don’t feel comfortable posting such are large amount of information about myself in the normal mail, if I send it to them via special delivery and request that they do the same when returning the documents are they likely to?

    Thanks again for the help

To be honest they won;t return them recorded - they won't return copies period. Only if you send in originals will they return them.

Royal Mail has been here a long time and worked fine in the old days, have some faith in them! :rotfl:

Re editing the appeal letter, thats cool - it was a basis to let people see what areas they look at. Not a guaranteed or fool proof way! :T

As marcellep says regards to recorded - they will not bear the cost.

Right so I am still preparing my appeals letter, however I am still slightly worried about sending off so much information about myself.

Whilst I am happy to send the statements etc via recorded delivery I am worried about how they will be handled by Barclays, surely if that information gets into the wrong hands it can easily lead to identity theft. I’m sure there must be a huge amount of regulation about how Barclays treat the data but as we know process/regulation isn’t always followed and doesn’t always work…

    Hiya

You'll never satisfy your curiosity - the banks do not look after this data, as you must read about same as I do.

Its a catch 22 - no1 will promise that it safe to send this data but if you want the account, then you must send it.

Without an original passport or something ID theft isn;t that easy - contrary to popular belief.....

You need to make your own decision on this one mate.

    Well time for another update!

I received a rather large envelope via special delivery, Yeah it was from Capital One.

Basically it was a reply to a subject access request that I sent away for about 3 or 4 weeks ago. It details all my account history and includes screen shops of all the manual entries on my account.

So here are some facts from the information they sent:

1.Bank charges total £300, I now have the evidence to support this!

2.No information on the account dating back to when the default was applied!

3.I made the last payment to this account on the 2nd of March 2005

I find it hard to believe that there would be no entries when they alleged they sent the default.

So the default is for £385 but that includes £300 of bank charges!!!!

Mate don't worry, they will remove the default! Wait and see what they write back with - put it this way, you already had em by the balls but now you've got them by the balls in a vice like grip (lovely!)

Just be patient and wait on reply to main letter (#170 ) - they may realise their own mistakes, not likely, but if they try and argue we'll use the fight that without any internal records then the debt does not exist - quite simply!

    Catch you soon matey :D
