    Thanks so much for the letter you have composed for me,
    This letter is far better than any I have ever sent them in the past. I will send it via recorded delivery tomorrow to them. I have the name of a person within the executive office, so I expect a prompt reply.
    You will be the first to know if I managed to get this default removed. I will send you a bottle of bubbly too:)

    Should go down a treat with them - by the time they have read it, they'll think !!!!!!? and probably just back down, in essence you're calling into question their actions from day one, retrospectively, meaning that unless they remove the adverse data you'll simply reclaim the charges thus cancelling the default as a default could never have been issued whilst you were reclaiming!

    Catch 22 for Cap1 i'm afraid :eek: Victory all round for you :T

    You've seen how they talk rubbish, in their letter they refer to the CC-CNCD Regs 1983 - I uploaded these for you and they say the opposite - they say a notice must be issued or the debt becomes unenforceable until such time as a notice has been issued!

    Anyway matey, keep me posted and remember to send a £1 cheque (postal order is better) for the CCA (I know you have one but we'll follow procedure to the letter this time to catch them out, one way or another!)

    I copied and pasted in to word document and corerct the few errors already.

    It's away recorded delivery today, so it's now time to wait and see what reply I get. :confused:

    Hi all,

    I just had a question about the appeal letter provided at the start of this letter.

    The appeal letter notes current account activity and refers to the attached statements so I was wondering if it be a good idea to also attach a statement of a savings account or ISA as proof of your finances. Would this be beneficial to the appeal or would it be considered totally irrelevant to the credit card application?

  • Just a quick Warning about getting your free credit rating check by using the 30 day trial credit checks offered on Creditexpert.co.uk. Even if you cancel your subscription with them they will continue to take £6.99 from your bank account until you actually cancel by phone. Something in the small print aparently. It is safer and cheaper to get your credit file directly from the credit reference agency (Usually £1).

    The statutory report you mention is £2, you obtain this by writing to the CRA enclosing your full name, date of birth and address history for the last 6yrs. You send a cheque/PO for £2 and within 30 days you'll get the report.

    Slow but I agree, well worth it!

    The £6.99 that you pay monthly is ideally suited to people who check their files daily, assuming they are clearing incorrect or adverse data.

    Hiya

    Yes, send anything that shows you have funds or current lending. Do you have any cards or a full bank account? Anything you send will show them that you can handle finances - this is the main point you're trying to make in any appeal.

    Ok I will also send them some statements relating to my savings accounts in that case, I have actually ended up editing the appeal letter quite a bit to take into account different things.

    I wanted to check, when sending this appeal letter and documents is it ok to send photocopies of the documents or will they require the originals?

    Another point is that I don’t feel comfortable posting such are large amount of information about myself in the normal mail, if I send it to them via special delivery and request that they do the same when returning the documents are they likely to?

    Photocopies will be fine for an appeal.

    Re sending it recorded delivery too them that is fine, I doubt any company will send it back to you recorded delivery unless you supply them a pre paid recorded delivery envelope.
