Parking

I don't know if I am posting this in the right area, but I am at my wits end and need some advice.

My husband is visually impaired and we live in housing specially built for blind and visually impaired people. It is a large complex and houses approximately 60 people. I myself am fully sighted. The complex has 2 car parks - 1 for staff and 1 for visitors. The staff carpark is behind a barrier whereas anybody can use the visitor one. Basically, we have asked if we can park in the staff car park as another tenant has a space for his partner to park in. We have been told that they have a space in the staff carpark because they were allowed by a previous manager and that all the other spaces are being used by staff. We therefore have to park in the visitors carpark and when it is busy have nowhere to park. They claim that the staff are essential car users. Part of our rent goes towards the upkeep of the grounds and therefore would mean to upkeep this carpark.

Sorry for such a long thread, but we feel we have hit a brick wall as we have taken this to the Cheif Executive and he backs his staff. It is very unfair that staff are put before tenants. Does anybody where I can go for more help? We have already tried CAB.

    Do you rent? If so check your tenancy agreement, that should tell you if you have a parking space (and its location) as part of your rent.

    In the plans (You might have to speak nicely to the man at planning dept) did they have to allocate any parking for the properties? (Or was it only single carless people allowed to live there originally?)

    Yes I do rent, but there isn't anything in our tenancy regarding a parking space. The only thing mentioned in the tenancy is that part of our rent goes towards the upkeep of the grounds, which the carpark is part of. Regarding the allocation of spaces, as the property was specifically built for visually impaired and blind people, is has never been an issue before. However, they do state that sighted partners are welcome. It seems that staff who work here are given priority parking over us who live here and pay rent.

    Sounds like your tenancy doesn't give you any parking rights. They are fully entitled to give priority to staff if they choose to do so.

    As you have stated, the tenants would not be expected to need car parking. Paying for upkeep of site as part of rent is condition of tenancy agreement and will not give you any right of having allocated parking space.

    I do sympathise but I don't think there is anything you can do.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    Surely those staff are entirely essential for the other tenants to be able to function/live... *you* drive the car and get the benefit - it's not the blind tenant who is doing the driving. You also get the benefit of specialised, adapted housing presumably at a reasonable rate. The entire complex sounds like it's some sort of sheltered/adapted building for those who can't live independently and don't have partners. A pushy sighted partner might push them to decide to only accommodate those without a partner who could care for them.

    The staff are not 'essential car users' as the job does not involve any driving. Once they are on site they do not need to drive anywhere. The problem I have is that part of our rent goes towards the upkeep of the carpark. One tenant has a space, yet we are not allowed one because it was an agreement with a previous tenant.

    As nothing has changed since the tenancy began, I doubt you really have a case.

    I don't think it's right, but you don't really have a leg to stand on.

    Perhaps you could make a case for an allocated space in the visitor's car park?
