  • It appears to me that one thing you need to do is to even have her admit that there is a problem - she either can't or won't see it!

    Do you have a mutual friend who you both trust sufficiently to act as an arbiter? Someone who you can confide in and who can then try and get her to understand how you feel?

    I think I understand where you are coming from - but do you really want out or will you settle for solving the root problems?

    I'm really rubbish at giving emotional advice as I'm a complete wreck myself and only 21 :P but as it so happens I'm revising for my Family Law Finals so I can give some advice there regarding nullity of marriage;

    A nullity will only be declared where the law recognises that there has been a flaw in the establishment of the marriage. This can happen in one of 2 ways:

    i) A void marriage being established, which can be annulled at the request of anyone. This happens when there is a) a prohibited degree of relationship, for example a brother and a sister marrying, b) an age issue as one of the parties is under 16, c) the legal formalities have not been completed, d) either party is already married or e) the parties are of the same sex.

    ii) A voidable marriage being established, which can be annulled at the request of either party to the marriage. This happens when a) the marriage has not been consummated, b) lack of consent, c) a veneral disease which the other party was not aware of, d) a sham marriage, e) mental disorder of either party which means they are "incapable of carrying out the ordinary duties and obligations of marriage" (Bennett v Bennett).

    Regarding your scenario it would be practically impossible to annul the marriage; sorry I haven't been much help!
