There hasn't been any letters memo of sale. Only one from the buyers solicitors saying that they are dealing with the purchase.
In a letter I got from my solicitors it says that "We understand that in addition to mortgage finance, our clients are also obtaining an Equity Loan from a Company linked with the mortgage provider. We currently await confirmation as to the full extent of our clients' borrowing and on receipt of this information, we will then confirm the amount of deposit available on exchange of contracts.

The EA refuse to as they put it Lie to prospective buyers and still keep telling anyone phoning that a sale is going through. Regardless what I say to them they just got nasty when I argued with them that there isn't a sale going through as a survey hasn't even been done yet. Its so frustrating its a pain that I can't threaten not to pay them if they don't advertise as I request. If this doesn't go through then I am going to cancel my agreement with them.

They havent even done any of the soliceter work, raised queries etc? If they havent after 4 weeks, you need to remarket, have a very STERN word with your EA and tell them they are working for you not the buyer, that you want to remarket with immediate effect, that you are happy to continue with these buyers, if they pull their fingers out and get on with it.
It very much sounds to me, like they are struggling to get a mortgage, and that they have informed their soliceter not to undertake any work, untill they have this sorted. Why cant people communicate.

I did have a stern chat with my EA which I got very close to tears as he was on the point of being nasty. Saying that we will frighten the buyers away if we persist too much and re-market. I even threatened to pull out within 24 hours if a survey hadn't been arranged.
I have received a set of questions from their solicitors but as it seems I think you are right they don't have a mortgage.
Seems like I have a useless solicitor and EA!! I can't really change solicitor as it will cost me but I will change my EA if this does fall through.... might be worth trying to sell it myself as the EA never turned up on time anyway!
I feel so frustrated I know I shouldn't complain as there are people out there in such a worse position than myself. I just wish things could be simple for once!0 -
I was in very much the same position as you when selling my last house, rainbowangel.
I received and accepted an offer within a couple of weeks and the EA advised me to take it off the market, then nothing happened for several weeks. It became clear that the buyers could not raise the mortgage they required. So I put it back on the market and the same thing happened all over again with another buyer.
I then researched the whole house buying process and in particular the Ombusdman for Estate Agents Code of Practice which I linked to earlier in this thread. I also rang the Ombudsman's office who were very helpful.
The EA is supposed to take reasonable steps to confirm that the buyer has finance arranged. If they require a mortgage this means having an agreement in principle (AIP). This means the lender has agreed to lend the money, subject only to a valuation of the property.
In my case there were also some issues concerning conflicts of interest and whether the EA had buyers on his books looking for properties like mine. To cut a long story short, I complained in writing to the EA, one of his staff bought the house and I wasn't charged any fees. I came out of it OK financially, but had six months of stress and sleepless nights.
Between selling my old house and buying this one I rented a flat. When I moved out my landlady sold it and had a similar experience to me so incompetent/lazy estate agents seem to be quite common
By contrast, when I bought my present house as a cash buyer the EA wanted me to provide a statement from my solicitor (who was holding the proceeds from my sale) and bank statements to prove I had the money. I took these in the day after my offer was accepted, had the survey done the following week and completed the purchase four weeks later. So things can go smoothly if everyone does their job properly.0 -

Good News I have just phoned the EA and they said on Thursday (God know's why they didn't let me know) they had a call from the buyers solicitor who confirmed the Survey should be done early next week! We will sit tight to find out!
I haven't completed any of the fixture/fittings form as I want to make sure they are genuine before I go to the hassle of completing it.
Fingers crossed all goes through ok. I think they are having a full structural survey but that should be ok as we only had a survey done a few years ago.
Will keep you all informed!

I have to agree with you here... I have had a feeling for a while that they are going to try and drop the price. They will have to think again as I won't drop the price any more than I already have. I know they love the house I do too so if it doesn't go through its not a real hardship. Although it would be nice if it does.
They are very keen to get the fixtures and fittings list!
