Hi, I hope someone can help me, I have been trying to reclaim my charges from the Halifax totaling £3500.00 under the financial hardship route. I received a letter on 19th January from them saying that due to my circumstances they would like to offer me a payment of £497.00 which is the amount of fees debited from my account between august 2009 and 19th January 2010. The offer is made without admission of liabillity and would be full and final settlement of my claim.
I am not sure if I can persue my claim and I dont really want to accept this offer as I want it all back. But due to the courts decision I don't know where I stand.
Please help!

No, I am behind in mortgage payments and owe Halifax money as my overdraft is over £1000.00 which I am unable to cover or pay off. And with their new charging systems I am just getting deeper and deeper into the mire.:(:(:(:(

The only thought I have is too call them or reply back to their letter. This is starting to take over my life and I dont want to lose everything while I am waiting.

Two further points: have you spoken to your mortgage lender with regards to payment difficulties to try and resolve some issues so that the arrears does not get any worse?
Is the account with halifax still open and being used as your main account?0 -
i finally got a refund. In december last year, the nationwide charged me £30 for a returned direct debit which was not paid because i had £16 in my account and the dd was for £19.99. After 3 months, 6 letters of complain, 14 formal complains on the phone, a careful rebuttal of each and every lame excuse given to me by the nationwide, a threat to sue them for £180 in expenses and after telling them that i posted all the letters and counterletters on the net, plus a formal demand under paragraph 2.18, page 12, section 140b of the unfair relationships enforcement action, part 8 of the enterprise act of 2002, i received a letter today that the £30 will be refunded to my account within the next 10 working days. Success, victory!, Pyrric victory, but victory nonetheless0

I have spoken to my lender and have sorted a repayment plan regarding the arrears, I have been lucky as my fixed deal ended and reverted to a standard BEBR + 3% so it is less now than before.
MY account with Halifax is still open and I am still using it but most of my money goes into my wifes account now so it does not get gobled up due t othe charges. Halifax have admitted in 2 letters that I am in financial difficulty, I really want to pursue them for the full amount. Do you think it is worth it??0 -

Pretty much yes, but my arrears on utilities and mortgage date back further. Also as an add on when I first applied to reclaim I did not use financial difficulty to begin with. My overdraft is now at £1600.00.0 -

Ok you need to rewrite to them and explain what the problems were, what happened, what you did ie contacting creditors and how the charges impacted on your ability to pay. Ask the to consider a refund of charges back to the point in which charges overtook your ability to pay priority creditors.0 -
