Damaged floor

Received a letter from them this morning which readsWe have now concluded our investigation into the alleged damage caused during the recent delivery of your appliance.
The drivers concerned have been interviewed by our transport manager and we are in receipt of their report which states that when they arrived to deliver the appliance there appeared to be a lot of work in progress as materials and tools were visible on the floor surface. The proof of delivery document also has been signed and there is no mention of any damage occurring at the time
We regret therefore, that after taking all the facts into consideration, Expert logistics are unable to consider your claim any further. I know this is not the answer you were looking for but I hope I have explained things clearly for you
How can they take the word of the delivery drivers? They are bound to save their @rse. I've also mentioned that I noticed the damage after they had left. Is there anything I can do? or should I just give up on this? Just makes my blood boil thinking they can get away with such !!!!!!!!! :mad:0 -
Do you know the name of the Insurance Company that sent the Loss Adjuster / Surveyor out?
If the claim being handled by the company who you bought the machine off or the delivery companies Insurers?
I think this is being handled by Expert logistics. I initially called the company I bought the dishwasher from (laskys), they forwarded the complaint to the delivery company and they have been in touch since0 -

I've no experience of this kind of thing, but presumably the only route available is to take legal advice. As it's your word against theirs, and you're both saying the other is lying, it'll be something that a court will have to decide upon. Be sure to keep us informed about where this goes from here.
Also, what about your home insurance? Have you contacted them to find out if you're covered? I know you'll be reluctant to claim on your insurance if you can prove the delivery men were responsible, but it may turn out to be your cheapest option.0 -
Does the delivery advice note ask you to sign that you are completely satisfied with the delivery method? that there were NO problems at all?
and if there were tools on the floor they could have asked for them to be moved and should still have carried the appliance in.
Try the INSURANCE OMBUDSMAN. <link there
You could get back to the insurance - write - tell them you are NOT satisfied and that if they maintain their position you will complain to the insurance ombudsman...
I have a two level floor in my kitchen and it was accidentally damaged (by my mother) so I claimed for new vinyl and initially they would only pay for the top part. Until I contacted them and pointed out that I would have had two completely different vinyls in one room ... the assessor had described the bottom part as 'a utility room' despite the fact that there is no door separating the two rooms..Don't put it DOWN; put it AWAY"I would like more sisters, that the taking out of one, might not leave such stillness" Emily Dickinson

TBH, I did not read the note. Delivery people always ask sign here and I doDoes the delivery advice note ask you to sign that you are completely satisfied with the delivery method? that there were NO problems at all?

I know it is a bit silly on my part and I should take care of what I sign. They are right that there was work going on, and there were tools at the side not in the way where the damage had occurred. I've already told the surveryor this. The fact is that the dishwasher was dragged on a pallet that caused the damage.
I'll try contacting the insurance ombudsman, although I have no experience in legal aspects and have never dragged anyone to courtTry the INSURANCE OMBUDSMAN. <link there

I'm very apprehensive going through the legal route as I've heard it is quite expensive and also the delivery company could have many tricks up their sleeve and a lot more resources at their disposal.
As the previous poster said I did consider making a claim on my home insurance, but given that I had already made a claim earlier this year when my phone was stolen I really can't take a chance making another claim and having my premium shoot up the next year

They would have had the dishwasher on a pallet in the truck as to secure it in travel. The problem is they should have removed the dishwasher from the pallet and took it into your house on a 2 wheeled trolley or simply carried it into your house.I think they have lowered the dishwasher from the truck on the tail lift then used a pallet truck to get it to your front/back door.
I guess they have pushed the pallet across your floor and the nails on the bottom of the pallet have marked your floor.Did they leave the pallet behind ?
This is negligence and should come off their public liability insurance.0 -

I think you have hit the nail on the head, the surveyor who came out was also harping on the fact that they should have used the 2 wheeled trolley. The fact is they DID NOT use any trolley and DID push the dishwasher on the pallet across the hallway and as you say the nails at the bottom probably caused the scratch marks. How in the world did the company decide in the delivery peoples favour is beyond me unless they claimed that they used a trolleyThey would have had the dishwasher on a pallet in the truck as to secure it in travel. The problem is they should have removed the dishwasher from the pallet and took it into your house on a 2 wheeled trolley or simply carried it into your house.I think they have lowered the dishwasher from the truck on the tail lift then used a pallet truck to get it to your front/back door.

Unfortunately I discarded the pallet at the recycling centre with the other stuff, I described the dimensions of the pallet to the surveyor, the fact that it was a smaller square than that of the dishwasher box and hence not apparent that the dishwasher was resting on a pallet0 -

In my mind it is gross negligence and make sure you pursue this.0
