Damaged floor

On friday (April 3rd, 2009) I took delivery of a dishwasher. I ordered the dishwasher from laskys. The customer service was great and the dishwasher is working like a charm :T The problem I have is with the delivery people, they turned up at the door and asked me where I would like the dishwasher and I told them to leave it in the dining area. After they left to my horror I found the floor scratched from the hallway to the dining area :mad: I saw them dragging the item but didn't think it would scratch it that bad. I noticed that the dishwasher was mounted on a pallet so perhaps that has caused it to scratch badly.

I called up laskys on Saturday and told them about this and they said they will forward it to the delivery company and any action will be taken by them.

So the question I had is what are my rights? Can I ask the delivery company to replace the floor? It is quite a big area of flooring from the hallway to the dining room and I had a quote of £700 for labour and materials. Do you think I can claim this off them?

    Their negligence has caused damage to your floor. It is probable that it can not be repaired so will need to be replaced. You will probably need to get a couple more estimates to demonstrate that the price is reasonable.
  • So before you even spoke to them you got a quote to replace it?

    Did you ask about repair?

    With all due respect, but have you actually seen the floor or even have any idea what material it is?

    I issued proceedings against a kitchen applicance supplier in exactly the same circumstances and recovered the full cost of a replacement floor. It was wooden and I had to get a specialist french polisher to report that it was impossible to polish the scratches out.

    It was about £3k of damage.

    If you have paid the appliance supplier fro the machine and the installation, it is they who are responsible. If you have paid the installation company direct, it may be that you need to pursue them.

    I'll need to replace it irrespective of the outcome, I cannot have such scratch marks. In any case, the quote was from the company who installed the dishwasher. The chap came by to collect his cheque and I got to chatting with him about the floor. He didn't give me a formal quote, just an estimate. I'll get formal quotes when I come to replacing it. The reason I'm not keen on repair is because it covers nearly 30% of the area, I mean the scratch from the hallway through to the dining area. It is a laminate flooring so not sure if it can be repaired anyway.

    Luckily at the time of delivery his workmen were at my place and I guess they can testify that the scratch marks were caused by the delivery people pushing the dishwasher on the pallet across the floor

    No but most floors would look very odd with a just one section replaced:confused:
    If you have paid the appliance supplier fro the machine and the installation, it is they who are responsible. If you have paid the installation company direct, it may be that you need to pursue them.

    You can go direct to the installation company irrespective of who you paid if your claim is in the law of negligence which is doesn't require a contractual relationship.

    Received a letter from the delivery company this morning asking for photographs of the damaged area and two quotes to put it right. Looks promising

    How will you need to replace it irrespective? it could be repaired possibly.

    You need to get a flooring expert to confirm that and get a quote from them. If you go straight in for a replacement without getting any proper advice they will rightly tell you where to go.

    Also I would suggest you need it from independent sources and not workmen who stand to benefit from blaming it on someone else - for all you know those workmen did it.

    OP has said that they need 2 quotes. He has one already. The other one will obviously be independent.

    Oh, and what evidence do you have that the particular workmen caused the damage? Precisely none.

    Lets keep to the facts and keep the conspiracy theories separate.
  • Quotes to put it right, not replace it, if he is getting quotes for replacement he should make sure those issuing quotes state that replacement is the only option.

    Do you genuinely think that he shouldnt have to even ask about repair simply because he fancies a new floor.
