    I double-checked this with a friend who is a Police Officer and he advised that keeping the tv is definately theft. Just because M&S made a mistake it doesn't mean that you have a right to the tv.

    You MIGHT get away with keeping it but on the other hand you might just end up with a criminal record.

    The chances are the original order was cancelled because they realised that they had made a mistake on the price. The contract to sell does not become legally binding until payment is taken.

    The internet is full of stories where things have been advertised for the wrong price, from memory I think that the initial advert is only an "invitation to treat" and until money is taken the retailer can cancel the order.

    Have you got a delivery note for it? Does it say your name and address on it etc??

    M&S need to get their act together, their website is farcical, serves them right if the lose a few TV's.


    If they didn't list stock then cancel orders, perhaps they would do better.


    I would keep it and say nothing.;)

    The fact it was delivered to the address and signed for is proof enough.

    yeah, I've got a delivery note and its got my name and address on. I don't want to steal anything(a free TV would be nice tho;)). What I really want is for them to send me the TV they advertised and I'll happily pay for it!

    Just because someone delivers something to your house, it doesn't mean its yours. Keeping it is the "deception" part.

    I got a free Sony 40X3000 because the company messed up on their refunds after I returned the first two faulty. £1600 they paid me back.

    I'll wait and see how long it takes for them to realise their mistake. I'm not gonna open the box and use the TV. When they do realise and contact me they can just come and pick it up. Surely I can't be held accountable. They are the ones that need to get their act together!

    You KNEW the order had been cancelled yet you accepted the tv without saying anything about it?
