finally got our response from FOS regarding the refund and they have said that as we would have received a booklet when the loan was processed and in the booklet it says you can have a refund when you pay the loan off we our complaint has not been upheld. if we disagree with this we can go to the ombudsman.

am gutted...


they still have our complaint regarding the mis-selling so that may still come back in our favour. but i'm doubtful.

I take it this complaint was against GE? I am confused here?

sorry,

we were trying to get refund for the PPI from GE Money.

and also trying to get Freedom Finance/Bespoke for mis-selling.

Yes, I thought that was the case. If you win the whole amount back for misselling then you would not have a rebate complaint. I would say this "could" be a good sign that FOS are going for the whole amount back.

no joy i'm afraid, as Bespoke were out of the FOS jurisdiction when we took the loan out.

letter suggests we try for the insurance company so need to ring FOS later to see what i need to do.

Hi Jillie, you need to find out who the insurer was and make the complaint against them. FOS will even write to them for you if need be but they will be under FOS jurisdiction and also not part of the Judicial Review either so you should not be held up. Do you have the actual policy document of the insurance at all? It says on there who were the insurer/underwriter.

have no policy documents. All we have is a letter they sent us before the 5 year policy was due to end. FOS already have that. So should be, hopefully straight forward. have been under the weather today so is on my list of calls for tomorrow.
