claiming ppi from capital one

I was just wondering if anyone out there could help me. I put a 1st stage letter to capital one, it came back 'sorry but we didn't missell this ppi to you' But some kind persons out there told me to keep on at them and so I sent another letter to them basically telling them that they had missold it to me. They have now sent a letter back stating " we maintain that the ppi was not mis-sold to you, however we would like to bring this matter to a speedy conclusion" They have offered me a proportion of the premiums of £615.46 ( dont know how they have come to this figure) I dont think this is enough and because I owe them money still, they say that they will deduct this of the amount of money I owe them. What do you think I should do, cut my loses or shoould I risk them not giving me anything at all?? Should I ask them for a breakdown of how they have reached this figure?? Sorry I have been a little long winded but I just dont know what to do. Thanks to anyone that will help me.

So they are offering you this on a goodwill offer then by the seems of it?
I would ask them to send you a full breakdown of how they come to this figure.
Have they given you a certain date to respond (timescale)?
However, if your not happy and you feel more money should be involved here, you should have the opportunity to take this to the Financial ombudsman service.
Have they suggested the Financial ombudsman service (FOS) if your not satisfied?
I believe a lot may suggest to take this to the FOS, but depending as well if the amount is a huge difference or not.
Bear in mind though if you decide to move this on to the FOS, you may have to wait a while before its moved on to an adjudicator, although you could also request for fast tracking if your struggling with financial hardship and have any personal reasons, they may consider this but its not guaranteed.;)
It could be worth your while asking if they could higher the amount first, its just a suggestion but until you try you never know.;)
I'm sure others will post up as well with some useful advice on this issue hun, fingers crossed to you and please keep us posted.

Thanks Di, they havent mentioned the FOS and they have not given a time to respond, just a form to sign so it can be credited to my account to reduce the amount I owe. I have had the account for some years and I have been paying ppi since day one!0

Maybe this is good then hun in regards of them not giving you a timescale on this, write back and ask for the breakdown as said in the above post, so you have something to work on.
If then there is a big difference, you could question this, if they do not resolve this then in your favour, you could move on to the FOS, normally they do let you know this in the final response.
I would also wait for others views here as well hun, good luck.;)

Have sent second letter to them saying that they are wrong and i will be taking the matter to FOS. Awaiting their response. I've worked out that i am due over £2000 in compensation. So it will be interesting to see the offer they present to me, if that is what they do.0 -

I am also in the same position with capital one, received my offer letter, after initial 'go away' letter, sent them one straight back basically saying this offer is not enough please look at the matter again, now just waiting to hear back, fingers crossed but its worth a try!

I am also having a battle with Capital One, they have sent me their final response saying they did not mis-sell the PPI, but I still believe they did. On my application form (some 10 years ago when I was very naive about money) I ticked the "yes" to PPI box, without properly understanding what it was. All Capital One see is the fact that I ticked this box and therefore requested it, do I have a case to take this to the FOS?
