Anyone organising their own DMP?

  • I received a letter from Capital One over the weekend saying that I had to choose between a short term and a long term payment plan, so I thought, great.

    So I rang them and they are insisting on bank statements, 3 months worth, so I said no! I said I have been on a DMP with CCCS for 2 years, I have sent all of the paperwork to them and they have advised me not to send anything to my creditors and I do believe it is an invasion of privacy, even the courts don't ask for bank statements so No I will not be sending any statements. They said if I don't send them then they will not be able to set up a payment plan and my debt with be passes onto a DCA, I said ok thats fine, and then said thank you and goodbye.

    It was scarey but I held my ground.

    Do you think I should have just sent the statements? I really think it would be a bad idea as they will see things on there like 'amazon' and 'debenhams' etc and I just really feel it would do more damage, not to mention its personal anyway.

    It never ceases to amaze me that these companies pay people to do a job who seem to know nothing about the rules and guidelines for debt collection. No of course you don't have to send bank statements- and yes you were right to stand your ground.
    They are just bluffing- as you say- let them pass the debt on then they will get a fraction of the money they would have got if they had let you agree to a payment plan. Hardly any wonder the banking system is in such a mess is it!

    Hi Kat

    I got one of these letters on Saturday as well.

    I didn't bother contacting them by phone justed posted reply saying we will opt for the long-term plan. I didn't enclose anything or supply any documents. I will keep you updated as and when the contact me again.

    Cheesedoffwithdebt - are there really rules about paperwork etc? Do you know what the rules are? It would help if I could quote them something, or if I knew what the rules were, then I could feel a bit braver next time!

    Hi All, just a quick update.

    We have now received a letter from the second council accepting our offer of payment. We also got an email from one of the bailiff companies and although it doesn't accept the offer (as they still say they can only deal with OH - he is sending an email to them giving me authority), they do at least acknowledge the offer.

    The last council (also with bailiffs) is going to be more difficult - it is for the smallest amount overall. They send a second copy of their letter saying: Final notice - we will come to remove goods. Now I know that is rubbish as they have not visited or entered the property or raised levy, also they can't levy on either car as they are both on HP and the bailiff company has been advised of this on our SoA. I will email them again about our offer.

    I've been amazed by the support received by myself and others since my LBM only 2 months ago, and I just wanted to say thanks to you and everyone else. The offers of support can really boost moral on those days when its all going t1ts up!:D
