My friend has just bought a lovely with a drive and a garage at the end of it.She moved in a couple of weeks ago and soon found the a car (Clio)will not go down the drive as it is too narrow. it cant even sit on the front part of the driveas it overhangs the footpath. I know its probs her own fault for not checking with a tape measure (who would?) but should the vendor/solicitor/surveyor not have pointed this out?

What did the house literature say? If it advertised it as having a garage and off road parking, then she should speak to her solicitor, as a clio is TINY.
If it didn't mention parking at all on the house details, then she has no come back.

As the others have said, it's best to check such things for yourself *but* I agree with Pinkshoes - your friend should look back at the particulars for the property and see how the drive/garage were described.
The Property Misdescriptions Act 1991 states that it is an offence for an EA/property developer to make misleading statements about a property:S1(5) For the purposes of this section—The local Council's Trading Standards Office is the enforcement authority if your friend thinks she has grounds to pursue the matter.
(a) “false” means false to a material degree,
(b) a statement is misleading if (though not false) what a reasonable person may be expected to infer from it, or from any omission from it, is false,
(c) a statement may be made by pictures or any other method of signifying meaning as well as by words and, if made by words, may be made orally or in writing.

i went to look at a late 70's estate house a number of years a go, they all had really long drives that would take at least 5 cars with a garage at the end, but I noticed none of the neighbours were using the drive.
I paced across just putting one heel againt the other foots toe and then went and did the same across the front of my car, then an astra, over 2 of my feet longer than the drive - no need for a tape measure but obviously never going to fit.
I'd say its just bad luck and down to experience that your friend didn't spot this and as she didn't ask that question out right then no one is to blame for not telling her.
Is there any front garden? can she turn it into hard standing to put the car onto?
As a word of caution for future always try things out, I once put a small corsa into a garage, I reversed in, and the pillars of the garage meant I could not get out passed the wing mirrors! Had to drive car out, turn it around and drive it in, even then the pillars made getting out difficult. If i'd been on the large side I wouldn't have got out at all.0 -
:rolleyes:A room described as a bedroom has to be able to take a standard sized bed. If a house is described as having off road parking it should be capable of taking a standard sized vehicle: the alternatives are either that the particulars should emphasise that only a moped or smart car will fit or that no mention at all is made of parking/vehicular garage access.
The room sizes where in the details for all to see. Common sense really (or lack of it)0 -

no - no - and no - your friend is trying to blame others for her own lack of foresight - suggests she buys a smaller car
Do you know her?, Did she tell you anyone else was to blame? didnt think so!
I personally blame the vendor, I think they deliberately mislead her, She blames herself.

No it doesn't matter now . She blames herself, I was just trying to find out if she had any comeback with the legalities of it. She was pretty sure she didnt but I just thought i'd ask on here for her

'The likes of me' dislikes people who are rude to others. You had a go at Clutton for allegedly missing something, but you find it hard to take the same medicine when someone else points out that you can miss things too.
